AN ORDINANCE, vacating a portion of a fifteen-foot (15’) wide easement
recorded in Deed Book 6452, Page 699, also a fifteen-foot (15’) wide easement recorded
in Deed Book 6452, Page 707 and a ten-foot (10’) wide easement recorded in Deed Book
10954, Page 1647 located in a tract of land being Part of Magnolia Trace according to the
plat thereof recorded in Plat Book 354, Pages 254 & 255 of the St. Louis County
Records, in the City of Ballwin, St. Louis County, Missouri; for the project known as
Magnolia Trace.
WHEREAS, the owners of the subject property have requested this District to
vacate said portion and subject easements, and this District has no further use for said
portion of easement and easements,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The portion of a fifteen-foot (15’) wide easement recorded in Deed
Book 6452, Page 699 in said tract of land being Part of Magnolia Trace as shown
hachured on the attached “Easement Vacation Plat”, and marked Exhibit “A-1” and made
a part hereof, is hereby vacated.
Section Two. The fifteen-foot (15’) wide easement recorded in Deed Book 6452,
Page 707 in said tract of land being Part of Magnolia Trace as shown hachured on the
attached “Easement Vacation Plat”, and marked Exhibit “A-2” and made a part hereof, is
hereby vacated.
Section Three. The ten-foot (10’) wide easement recorded in Deed Book 10954,
Page 1647 in said tract of land being Part of Magnolia Trace as shown hachured on the
attached “Easement Vacation Plat”, and marked Exhibit “A-3” and made a part hereof, is
hereby vacated.
The foregoing Ordinance was adopted July 10, 2008.
