AN ORDINANCE, authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into
required contracts for a mediator for the lawsuit, United States of America, The
State of Missouri, and Missouri Coalition for the Environment Foundation v. The
Metropolitan St. Louis Sewer District,
WHEREAS, mediation is being conducted in lieu of costly litigation.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN
ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter
into required contracts for a mediator to provide Mediation Services for the
lawsuit United States of America, The State of Missouri, and Missouri Coalition for
the Environment Foundation v. The Metropolitan St. Louis Sewer District.
Section Two. All parties to the lawsuit have agreed that JAMS
mediator, Michael K. Lewis, Esq., will conduct the mediation and the expenses
associated therewith shall be encumbered by the parties as there so agreed.
Section Three. The contract authorized in Section One of this
ordinance shall be comprised of such other terms and conditions as are
approved by the office of the General Counsel of the District.
Section Four. The Mediation Services as provided for herein are
essential to reaching an amicable conclusion to the above stated matter, and
must be procured without delay, thus creating an emergency within the
meaning of the Charter. Accordingly, this ordinance shall take effect
immediately upon its enactment.
The foregoing Ordinance was adopted July 10, 2008.
