ORDINANCE NO. 12772
AN ORDINANCE, making a supplemental appropriation of Four Million Six
Hundred Thousand Dollars ($4,600,000.00) from the Sanitary Replacement Fund of the District,
and transferring said sum to the Water Backup Fund to provide for water backup claims and
expenses related to the September 14, 2008 rain event and remaining Fiscal Year 2008-2009
costs.
WHEREAS, Ordinance No. 12660, adopted June 12, 2008, appropriated the
initial funding for the Water Backup Insurance Fund, and
WHEREAS, the cost of water backup claims associated with tropical depression
Ike, substantially depleted the budgeted appropriation, and
WHEREAS, it is necessary to appropriate an additional $4,600,000.00 from the
Capital Improvement and Replacement Fund; and
WHEREAS, it is the intent to reimburse the Sanitary Replacement Fund from the
budget for Fiscal Year 2010.
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation authorized
herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Four Million Six Hundred Thousand Dollars
($4,600,000.00) is hereby appropriated from the Sanitary Replacement Fund of the District, and
said sum is hereby transferred to the Water Backup Fund to provide for funding of customer
claims and administrative expenses.
Section Two. This ordinance, being an appropriation ordinance, shall
take effect immediately upon its enactment.
