AN ORDINANCE, appropriating Nine Hundred Fifty
Thousand Dollars ($950,000.00) from the Stormwater Facilities Fund to
be used for project costs for streambank stabilization in Pepperdine
Court - Fishpot Creek Bank Stabilization (2008157), in unincorporated
St. Louis County, Missouri; and authorizing the Executive Director and
Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer
District to enter into a contract with Goodwin Bros. Const. Co. and
authorize an Agreement with St. Louis County to reimburse the District
for approximately Four Hundred Seventy-five Thousand Dollars
($475,000.00) for their share of the total project costs; for streambank
stabilization.
WHEREAS, this ordinance will authorize a temporary
transfer of Nine Hundred Fifty Thousand Dollars ($950,000.00) from the
Operation, Maintenance and Construction Improvement Fund of Deer
Creek to the Stormwater Facilities Fund for immediate construction of
this project.
WHEREAS, Nine Hundred Fifty Thousand Dollars
($950,000.00) will be returned to the Operation, Maintenance and
Construction Improvement Fund of Deer Creek when sufficient funds are
available in the Stormwater Facilities Fund.
WHEREAS, the bid for streambank stabilization is Eight
Hundred Twelve Thousand Dollars ($812,000.00), and the allowance for
construction change orders and other project expenses is One Hundred
Thirty-eight Thousand Dollars ($138,000.00), and
WHEREAS, the Director of Finance has certified that there is
an unencumbered balance in the above-named fund sufficient to pay the
obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT
Section One. The sum of Nine Hundred Fifty Thousand
Dollars ($950,000.00) is hereby appropriated from the Stormwater
Facilities Fund to be used for project costs for streambank stabilization
in Pepperdine Court - Fishpot Creek Bank Stabilization (2008157), in
unincorporated St. Louis County, Missouri.
Section Two. The Executive Director and Secretary-
Treasurer are hereby authorized on behalf of The Metropolitan St. Louis
Sewer District to enter into a contract with Goodwin Bros. Const. Co. as
the lowest responsible bidder for streambank stabilization in Pepperdine
Court - Fishpot Creek Bank Stabilization (2008157), in unincorporated
St. Louis County, Missouri, pursuant to bids received and opened on the
11th day of December 2008; and authorize an Agreement with St. Louis
County to reimburse the District for approximately Four Hundred
Seventy-five Thousand Dollars ($475,000.00) for their share of the total
project costs.
Section Three. The sum of Nine Hundred Fifty Thousand
Dollars ($950,000.00) is hereby approved for transfer from the Operation,
Maintenance and Construction Improvement Fund of Deer Creek to the
Stormwater Facilities Fund.
Section Four. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted January 8, 2009.
