HomeMy Public PortalAbout12843O R D I N A N C E NO. 12843 AN ORDINANCE, declaring the necessity for the acquisition of easements and licenses in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as CC-14 Creve Coeur Creek Sanitary Relief (SKME-026) (89132A) to serve the needs of residents of the area, and authorizing the acquisition of said easements and licenses by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of the County of St. Louis within the Creve Coeur Creek Watershed wherein live and work numerous people; and WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and licenses in real property for the construction of sewers and related appurtenances in the project known as CC-14 Creve Coeur Creek Sanitary Relief (SKME-026) (89132A) as hereinafter set forth, said easements and licenses being more particularly described below: Creve Coeur Creek Sanitary Relief (SKME-026) M.S.D. Project No. 89132A MSD’s Parcel #3 A 10.00 FOOT WIDE SEWER EASEMENT across part of Lot 5 in Bellecoeur Plat 1, a subdivision as recorded in Plat Book 89, Page 49 of the St. Louis County, Missouri Recorder's Office, being more particularly described as follows: COMMENCING at the northwest corner of said Lot 5; THENCE North 68 degrees 43 minutes 36 seconds East, along the common line between Lot 5 and Lot 6 of said Bellecoeur Plat 1, a distance of 123.72 feet to the POINT OF BEGINNING of the centerline of the herein described 10.00 FOOT WIDE SEWER EASEMENT; THENCE South 29 degrees 56 minutes 40 minutes East a distance of 152.27 feet to the POINT OF TERMINATION of the centerline of the herein described 10.00 FOOT WIDE SEWER EASEMENT, excepting therefrom those portions covered by the existing 10.00 foot wide and existing 7.50 foot wide easements as recorded in said Plat Book 89, Page 49. Also, a 15.00 FOOT WIDE TEMPORARY CONSTRUCTION LICENSE NO. 1 and a 20.00 FOOT WIDE TEMPORARY CONSTRUCTION LICENSE NO. 2 for use during the construction of any sewer in the above described sewer easement, said temporary construction license being more particularly described as follows: A 15.00 FOOT WIDE TEMPORARY CONSTRUCTION LICENSE NO. 1 A 15.00 foot wide temporary construction license adjacent to the west line of the above described 10.00 FOOT WIDE SEWER EASEMENT, bounded on the north by the said common line of Lot 5 and Lot 6 and bounded on the south by the common line of Lot 5 and Lot 4 of said Bellecoeur Plat 1, excepting therefrom those portions covered by the existing easements recorded in said Plat Book 89, Page 49. A 20.00 FOOT WIDE TEMPORARY CONSTRUCTION LICENSE NO. 2 A 20.00 foot wide temporary construction license adjacent to the east line of the above described 10.00 FOOT WIDE SEWER EASEMENT, bounded on the north by the said common line of Lot 5 and Lot 6 and bounded on the south by the said common line of Lot 5 and Lot 4 of Bellecoeur Plat 1, excepting therefrom those portions covered by the existing easements recorded in said Plat Book 89, Page 49. The 15.00 FOOT WIDE TEMPORARY CONSTRUCTION LICENSE NO. 1 and 20.00 FOOT WIDE TEMPORARY CONSTRUCTION LICENSE NO. 2 will become null and void upon completion of the above described sewer construction. Project No. 89132A MSD’s Parcel #4A A VARIABLE WIDTH SEWER EASEMENT across part of Lot 13 of Bellecoeur Plat 2, a subdivision as recorded in Plat Book 96, Page 08 of the St. Louis County, Missouri Recorder's Office, being more particularly described as follows: COMMENCING at the northwest corner of said Lot 13, said northwest corner also being the southwest corner of the Common Ground of Bellerive Springs, a subdivision as recorded in Plat Book 298, Page 47 of said Recorder’s Office; THENCE South 87 degrees 40 minutes 53 seconds East, along the north line of said Lot 13, a distance of 46.13 feet to the POINT OF BEGINNING of the VARIABLE WIDTH SEWER EASEMENT; THENCE South 87 degrees 40 minutes 53 seconds East, along said north line, a distance of 17.28 feet to a point; THENCE South 28 degrees 52 minutes 36 seconds East a distance of 124.02 feet to a point, said point being on the southwest line of said Lot 13; THENCE North 49 degrees 55 minutes 43 seconds West, along the said southwest line, a distance of 0.74 feet to a point; THENCE North 35 degrees 08 minutes 23 seconds West, along the northeast line of an existing 10.00 foot wide easement as recorded in Deed Book 4174, Page 08 of said Recorder’s Office, a distance of 133.07 feet to the POINT OF BEGINNING. A 20.00 FOOT WIDE TEMPORARY CONSTRUCTION LICENSE for use during the construction of any sewer in the above described VARIABLE WIDTH SEWER EASEMENT, said TEMPORARY CONSTRUCTION LICENSE being more particularly described as follows: A 20.00 foot wide temporary construction license adjacent to the northeast line of above described VARIABLE WIDTH SEWER EASEMENT, bounded on the north by the said north line of Lot 13 and bounded on the southwest by the said southwest line of Lot 13, excepting therefrom those covered by the existing 15.00 foot wide easement as recorded in said Plat Book 96, Page 08 of said Recorder’s Office. THE 20.00 FOOT WIDE TEMPORARY CONSTRUCTION LICENSE will become null and void upon completion of the above described sewer construction. Creve Coeur Creek Sanitary Relief (SKME-026) M.S.D. Project No. 89132A MSD’s Parcel #5 A 10.00 foot wide SEWER EASEMENT across Lot 4 of Bellecoeur Plat 1, a subdivision as recorded in Plat Book 89, Page 49 of the St. Louis County, Missouri Recorder's Office, being more particularly described as follows: COMMENCING at the northwest corner of said Lot 4; THENCE South 88 degrees 47 minutes 36 seconds East, along the north line of said Lot 4, a distance of 39.01 feet to the POINT OF BEGINNING of the centerline of herein described 10.00 foot wide SEWER EASEMENT; THENCE South 07 degrees 16 minutes 13 seconds East a distance of 173.13 feet to a point; THENCE South 80 degrees 25 minutes 57 seconds East a distance of 129.30 feet to the POINT OF TERMINATION of the centerline of herein described 10.00 foot wide SEWER EASEMENT, said POINT OF TERMINATION also being on the west right of way line of Chasselle Lane. Project No. 89132A MSD’s Parcel #6 A 10.00 FOOT WIDE SEWER EASEMENT across part of Lot 96 in Bellecoeur Plat 1, as recorded in Plat Book 89, Page 49 of the St. Louis County, Missouri Recorder's Office, being more particularly described as follows: COMMENCING at the southeast corner of said Bellecoeur Plat 1; THENCE North 88 degrees 47 minutes 36 seconds West along the south line of said Lot 96, said south line also being the north line of Ladue (60’ wide) Road, a distance of 185.30 feet to the POINT OF BEGINNING of the centerline of the herein described 10.00 FOOT WIDE SEWER EASEMENT; THENCE North 00 degrees 05 minutes 16 seconds West a distance of 35.81 feet to a point; THENCE North 80 degrees 25 minutes 57 seconds West a distance of 28.94 feet to a point on the west line of said Lot 96, said west line also being the east right of way line of Chasselle (variable width) Lane and being the POINT OF TERMINATION of the centerline of said 10.00 FOOT WIDE SEWER EASEMENT. A VARIABLE WIDTH TEMPORARY CONSTRUCTION LICENSE NO. 2 A variable width temporary construction license adjacent to the west line and the south line of above described 10.00 FOOT WIDE SEWER EASEMENT, bounded on the south by the said north right of way line of Ladue (60’ wide) Road and bounded on the west by the said east right of way line of Chasselle (variable width) Lane. TEMPORARY CONSTRUCTION LICENSE NO. 1 and NO. 2 will become null and void upon completion of the above described sewer construction. Creve Coeur Creek Sanitary Relief (SKME-026) M.S.D. TEMPORARY CONSTRUCTION LICENSE NO. 1, NO. 2, NO. 3 and NO. 4 will become null and void upon completion of the above described sewer construction. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing Ordinance was adopted April 9, 2009.
