HomeMy Public PortalAbout12847ORDINANCE NO. 12847 AN ORDINANCE, vacating any rights, title, or interest of the District in all of or part of the portions of easements as recorded in the following: Deed Book 11069, Page 1862; Deed Book 11141, Page 1783; Deed Book 11170, Page 1746; Deed Book 11170, Page 1750; Deed Book 15629, Page 2017; Deed Book 15629, Page 2022; Deed Book 15629, Page 2027; Deed Book 4546, Page 468; Deed Book 4582, Page 304; Deed Book 4582, Page 306; Deed Book 6918, Page 1080; Deed Book 1666, Page 250; Deed Book 1771, Page 514; Deed Book 6276, Page 1400; Deed Book 8477, Page 2299; Deed Book 8597, Page 153; Deed Book 4582, Page 465; Deed Book 7101, Page 998; Deed Book 7624, Page 2399; Deed Book 8784, Page 278; Deed Book 9492, Page 1921; Deed Book 9492, Page 1924; Deed Book 9642, Page 1847; Deed Book 4546, Page 462; Deed Book 4582, Page 461; Deed Book 4582, Page 463; Deed Book 4546, Page 518; Deed Book 7103, Page 1809; Deed Book 9681, Page 1727; Deed Book 4582, Page 300; Deed Book 4582, Page 302; Deed Book 4582, Page 461; and Deed Book 7655, Page 1402; also any rights, title, or interest of the District in all of or part of the portions of easements and any rights, title, or interest of the District in all of or part of the portions in Wrought Iron Lane, fifty foot (50’) wide vacated by City of Manchester Ordinance 07-1804, according to the plat thereof recorded in Plat Book 171, Page 85; also any rights, title, or interest of the District in all of or part of the portions of easements according to the plat thereof recorded in Plat Book 352, Pages 617-618; also any rights, title, or interest of the District in all of or part of the portions of easements according to the plat thereof recorded in Plat Book 287, Page 10; also any rights, title, or interest of the District in all of or part of the portions of easements and any rights, title, or interest of the District in all of or part of the portions in McNulty Drive, forty foot (40’) wide vacated by said Ordinance 07-1804, according to the plat thereof recorded in Plat Book 55, Page 92; also any rights, title, or interest of the District in all of or part of the portions in Hill Avenue, forty foot (40’) wide vacated by said Ordinance 07-1804 and City of Manchester Ordinance 08- 1842, according to the plat thereof recorded in Plat Book 19, Page 25; also any rights, title, or interest of the District in all of or part of the portions in Brittany Parkway, sixty foot (60’) wide vacated by said Ordinance 07-1804, according to the Plat thereof recorded in Plat Book 116, Page 52; also any rights, title, or interest of the District in all of or part of the portions of easements according to the plat thereof recorded in Plat Book 323, Page 38, all of which are shown cross hachured and noted “TO BE VACATED BY SEPARATE DOCUMENT” according to Manchester Highlands Easement Plat as recorded in Plat Book 356, Pages 342-344 located in a tract of land being a Part of Section 31, Township 45 North, Range 5 East of the 5th Principal Meridian in the City of Manchester, St. Louis County, Missouri; for the project known as Manchester & 141 (Manchester Highlands) P-0027530-00. WHEREAS, the owners of the subject property have requested this District to vacate any rights, title, or interest of the District in the portions of the subject easements and any rights, title or interest of the District in the portions in Wrought Iron Lane, McNulty Drive, Hill Avenue, and Brittany Parkway, and this District has no further use for said portions of easements and portions of Wrought Iron Lane, McNulty Drive, Hill Avenue, and Brittany Parkway, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Any rights, title or interest of the District in the portions of the subject easements and any rights, title or interest of the District in the portions in Wrought Iron Lane, McNulty Drive, Hill Avenue, and Brittany Parkway, and this District has no further use for said portions of easements and portions of Wrought Iron Lane, McNulty Drive, Hill Avenue, and Brittany Parkway is hereby vacated. The foregoing Ordinance was adopted April 9, 2009.
