AN ORDINANCE, appropriating Four Hundred Thousand Dollars ($400,000.00)
from the Operation, Maintenance and Construction Improvement Fund of Gravois Creek to be
used for project costs for streambank erosion protection and biostabilization in Sappington Creek
at Kamping Lane Storm Channel Improvements (2003034), in unincorporated St. Louis County,
Missouri; and authorizing the Executive Director and Secretary-Treasurer on behalf of The
Metropolitan St. Louis Sewer District to enter into a contract with Fred M. Luth & Sons, Inc. for
the aforesaid construction.
WHEREAS, the bid for said streambank erosion protection and biostabilization is
Three Hundred Thirty Thousand Sixty-One Dollars ($331,061.00) and the allowance for
construction change orders and other project expenses is Sixty-Nine Thousand Nine Hundred
Thirty-Nine Dollars ($69,939.00), and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Four Hundred Thousand Dollars ($400,000.00) is
hereby appropriated from the Operation, Maintenance and Construction Improvement Fund of
Gravois Creek to be used for project costs for streambank erosion protection and biostabilization
in Sappington Creek at Kamping Lane Storm Channel Improvements (2003034), in
unincorporated St. Louis County, Missouri.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into a contract with
Fred M. Luth & Sons, Inc. as the lowest responsible bidder for streambank erosion protection
and biostabilization in Sappington Creek at Kamping Lane Storm Channel Improvements
(2003034), in unincorporated St. Louis County, Missouri, pursuant to bids received and opened
on the 26th day of March 2009.
Section Three. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing Ordinance was adopted June 11, 2009.
