HomeMy Public PortalAbout12904ORDINANCE NO. 12904 AN ORDINANCE, declaring the necessity for the acquisition of real property within The Metropolitan St. Louis Sewer District for the purpose of purchasing property due to inadequate storm and sanitary sewers for the project known as Harlem – Baden Relief Phase IV (Herbert Acquisition) (2003039A) related to the construction of a stormwater detention basin to serve the needs of residents of the area, and authorizing the acquisition of said real property by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area in the City of St. Louis within the Bissell Point Area Watershed wherein live and work numerous people; and WHEREAS, storm water and sanitary sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by the acquisition of said real property for construction of said stormwater detention basin and related appurtenances to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise real property for stormwater detention basin and related appurtenances related to the project known as Harlem – Baden Relief Phase IV (Herbert Acquisition) (2003039A) as hereinafter set forth, said real property being more particularly described below: Harlem – Baden Relief Phase IV (Hebert Acquisition) M.S.D. Project No. 2003039A Parcel No. 7 LOT 1 AND THE NORTH 12 FEET OF LOT 2 IN BLOCK 1 OF MARS PLACE ADDITION AND IN BLOCK 5239 OF THE CITY OF ST. LOUIS, TOGETHER FRONTING 57 FEET ON THE WESTLINE OF CLARA AVENUE, BY A DEPTH WESTWARDLY OF 135 FEET TO THE WEST LINE OF SAID LOTS, HAVING A WIDTH ON THE WEST OF 56.62 FEET, BOUNDED BY ASHLAND AVENUE. PART OF LOTS 35 AND 36 IN BLOCK 2 OF MARS PLACE ADDITION CITY BLOCK 6132 BEGINNING AT A POINT IN THE SOUTH LINE OF HEBERT STREET 9 FEET 11-1/2 INCHES EAST OF THE NORTH WEST CORNER OF LOT 36, THENCE WEST ALONG THE SOUTH LINE OF HEBERT STREET 41 FT. 11-1/2 INCHES TO A POINT 3 FEET EAST OF THE NORTH WEST CORNER OF LOT 35 THENCE SOUTH 146 FEET 8 INCHES TO A POINT IN THE NORTH LINE OF AN ALLEY BEING 3 FT. 3/8 INCHES EAST OF THE SOUTH WEST CORNER OF LOT 35 THENCE EAST ALONG THE NORTH LINE OF AN ALLEY 44 FEET 1-3/4 INCHES TO A POINT 11 FEET 9- 5/8 INCHES EAST OF THE SOUTH WEST CORNER OF LOT 36 THENCE NORTH 141 FT. 3-3/8 INCHES TO THE POINT OF BEGINNING. LOT 24 IN BLOCK 1 OF MARS PLACE ADDITION, A SUBDIVISION IN ST. LOUIS CITY, MISSOURI AND IN CITY BLOCK NO. 5239, FRONTING 35 FEET ON THE WEST LINE OF BLACKSTONE AVENUE BY DEPTH WESTWARDLY OF 125 FEET ON ITS NORTH LINE AND 125.90 FEET ON ITS SOUTH LINE TO AN ALLEY ON WHICH SAID LOT HAS A WIDTH OF 45.96 FEET. THE WESTERN 21 FEET OF LOT 22 AND THE EASTERN 9 FEET OF LOT 23 IN BLOCK 2 OF MARS PLACE ADDITION AND IN BLOCK 6132 OF THE CITY OF ST. LOUIS. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing Ordinance was adopted June 11, 2009.
