AN ORDINANCE, amending Ordinance No. 12904, as adopted June 11, 2009, by
repealing Section One, and enacting a new Section One in lieu thereof in order to identify the
Parcel Numbers.
WHEREAS, Section One of Ordinance No. 12904, as adopted June 11, 2009,
provided the legal property descriptions, it did not indicate the associated parcel number, and
said legal property descriptions should be amended to include the associated parcel number.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. Section One of Ordinance No. 12904, as adopted June 11, 2009, is
hereby repealed in order to amend the legal property descriptions to include the associated parcel
number.
Section Two. A new Section One of Ordinance 12904 is hereby enacted to read as
follows:
Section One. In order to protect the public health and relieve dangerous
conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or
otherwise real property for stormwater detention basin and related appurtenances related to the
project known as Harlem – Baden Relief Phase IV (Herbert Acquisition) (2003039A) as
hereinafter set forth, said real property being more particularly described below:

LOT 1 AND THE NORTH 12 FEET OF LOT 2 IN BLOCK 1 OF MARS PLACE ADDITION
AND IN BLOCK 5239 OF THE CITY OF ST. LOUIS, TOGETHER FRONTING 57 FEET ON
THE WESTLINE OF CLARA AVENUE, BY A DEPTH WESTWARDLY OF 135 FEET TO
THE WEST LINE OF SAID LOTS, HAVING A WIDTH ON THE WEST OF 56.62 FEET,
BOUNDED BY ASHLAND AVENUE.

INCHES EAST OF THE NORTH WEST CORNER OF LOT 36, THENCE WEST ALONG THE
SOUTH LINE OF HEBERT STREET 41 FT. 11-1/2 INCHES TO A POINT 3 FEET EAST OF
THE NORTH WEST CORNER OF LOT 35 THENCE SOUTH 146 FEET 8 INCHES TO A
POINT IN THE NORTH LINE OF AN ALLEY BEING 3 FT. 3/8 INCHES EAST OF THE
SOUTH WEST CORNER OF LOT 35 THENCE EAST ALONG THE NORTH LINE OF AN
ALLEY 44 FEET 1-3/4 INCHES TO A POINT 11 FEET 9-5/8 INCHES EAST OF THE SOUTH
WEST CORNER OF LOT 36 THENCE NORTH 141 FT. 3-3/8 INCHES TO THE POINT OF
BEGINNING.

MISSOURI AND IN CITY BLOCK NO. 5239, FRONTING 35 FEET ON THE WEST LINE OF
BLACKSTONE AVENUE BY DEPTH WESTWARDLY OF 125 FEET ON ITS NORTH LINE
AND 125.90 FEET ON ITS SOUTH LINE TO AN ALLEY ON WHICH SAID LOT HAS A
WIDTH OF 45.96 FEET.

Section Two. Counsel for The Metropolitan St. Louis Sewer District is hereby
authorized to enter into contracts to acquire by purchase if possible, or to institute and prosecute
an action in condemnation pursuant to the provisions of the Charter of The Metropolitan St.
Louis Sewer District and the laws of the State of Missouri for the appropriation of private
property rights as hereinabove set out.
The foregoing Ordinance was adopted August 13, 2009.
