HomeMy Public PortalAbout12969ORDINANCE NO. 12969 AN ORDINANCE to extend the boundaries of The Metropolitan St. Louis Sewer District to include an area of St. Louis County which could be efficiently served by the drainage facilities of the District; and WHEREAS, petitions signed by a majority of the owners of the land in said area, who are also the owners of more than one-half of the land area therein, praying for annexation of said area by The Metropolitan St. Louis Sewer District and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of The Metropolitan St. Louis Sewer District; and WHEREAS, this area adjoins The Metropolitan St. Louis Sewer District, and that the interests of sanitation and public health of the District and the Subdistrict will be promoted by including the area in their respective territories; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. That the Board finds that the sewer or drainage facilities of the District can efficiently serve the area described in Exhibit A, as attached hereto. Section Two. That petitions signed by a majority of the owners of the land in said area, who are also the owners of more than one-half of the land area therein, praying for annexation of said area by The Metropolitan St. Louis Sewer District and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of The Metropolitan St. Louis Sewer District. Section Three. That the interests of sanitation and public health of the District, as well as the area proposed to be annexed, will be promoted by including said area in their respective territories. Section Four. That the Caulks Creek system contracts and cost recovery fees, as authorized by Ordinance No. 9249, adopted June 8, 1994, will be collected for deposit to the Caulks Creek Construction Fund, to pay the District for portions of the costs for design, construction and renovation of sanitary sewers and appurtenances tributary to said system, which system will then provide the necessary sewer service to the areas proposed for annexation as described in Exhibit A. Section Five. That the sewage flow from the area proposed to be annexed has no other available adequate sewer outlet or treatment facility. Section Six. That the Board of Trustees, after examination and consideration of the facts, hereby grants the petition for annexation of said area, and hereby declares that the corporate boundaries of The Metropolitan St. Louis Sewer District are hereby respectively extended so as to include the area described in Exhibit A, as attached hereto. Section Seven. Certified copies of this Ordinance shall be filed in the offices of the Recorder of Deeds of St. Louis County, the Recorder of Deeds of the City of St. Louis and the Secretary of State. ORDINANCE NO. 12969 Exhibit “A” METROPOLITAN ST. LOUIS SEWER DISTRICT ANNEXATION A tract of land being located in U.S. Surveys 132, 134, and 1937, Township 45 North, Range 3 East of the Fifth Principal Meridian, Cities of Chesterfield and Wildwood, St. Louis County, Missouri being more particularly described as follows: Beginning at the northeast corner of a tract of land as conveyed to Jack J. & Patricia M. Schwartz by instrument recorded in Book 6999, Page 657 of the St. Louis County Records; thence eastwardly along the prolongation of the northern line of said Schwartz tract to the intersection with the centerline of Eatherton Road (variable width), said centerline being the boundary line of the Metropolitan St. Louis Sewer District service area; thence in a southerly and westerly direction along said centerline and boundary line of the Metropolitan St. Louis Sewer District service area to the intersection with the eastwardly prolongation of the southern line of a tract of land as conveyed to Eatherton Investment, L.L.C. by instrument recorded in Book 13816 Page 01 of the St. Louis County Records; thence westerly along said prolongation and the southerly line of said Eatherton Investment, L.L.C. tract to the southwest corner of said Eatherton Investment, L.L.C. tract; thence northerly along the westerly line of said Eatherton Investment, L.L.C. tract to the northwest corner of said Eatherton Investment, L.L.C. tract, said point also being located on the southerly line of a tract of land as conveyed to Fick Supply Service, Inc. by instrument recorded in Book 13999, Page 1665 of above said records; thence westerly along said southerly line to the easterly line of a tract of land described in a deed to Charlotte M Hoch Trust as recorded in Book 14454 Page 778 of the St. Louis County Records; thence northeasterly along said easterly line to the northeastern corner of said Hoch tract; thence in a northwesterly direction to the western line of St. Louis County, Missouri; thence in a northeasterly direction along said western county line to its intersection with the western prolongation of the northerly line of a tract of land as conveyed to Jerome E. Glick by instrument recorded in Book 7107, Page 717 of above said records; thence easterly along said northerly line and its prolongation to the west line of above said Jack J. & Patricia M. Schwartz tract; thence northerly along said west line to the northwest corner of said Jack J. & Patricia M. Schwartz tract; thence easterly along the northerly line of said Jack J. & Patricia M. Schwartz tract to the Point of Beginning. The foregoing Ordinance was adopted October 8, 2009.
