AN ORDINANCE, vacating a ten (10’) foot wide and a fifteen (15’) foot wide
permanent sewer easement and four (4) temporary construction licenses as part of a settlement to
the condemnation case known as, Circuit Court, Cause No. 07CC-000540, located across part of
Lot 25 of Charles H. Giers Estate in Section 32, Township 46 North, Range 6 East according to
the plat there of recorded in Plat Book 6, Page 3 of St. Louis County Records, in the City of
Overland, St. Louis County, Missouri, for the project known as UR-06 Upper River Des Peres
Sanitary Relief Phase II (89170).
WHEREAS, the owners of the subject property has granted to the District a
suitable alternate easement, the owners request the District to vacate the subject easements and
temporary construction licenses, and the District has no further use for said easements and
temporary construction licenses.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The ten (10’) foot wide and fifteen (15’) foot wide permanent sewer
easement and four (4) temporary construction licenses as part of a settlement to the
condemnation case know as, Circuit Court, Cause No. 07CC-000540 located in said part of Lot
25 of Charles H. Giers Estate in Section 32, Township 46 North, Range 6 East is hereby vacated.
The foregoing Ordinance was adopted October 8, 2009.
