AN ORDINANCE, vacating any rights, title or interest in a variable width
easement recorded in Deed Book 3887, Page 56, and a portion of a ten (10) foot wide easement
recorded in Deed Book 8857, Page 2473 and also recorded in Deed Book 8857, Page 2476
located in part of Lots 1 and 2 of Dellwood Retail Resubdivision Plat in the Southwest Quarter
of Section 6, Township 46 North, Range 7 East according to the plat thereof recorded in Plat
Book 356, Page 596, of the St. Louis County Records, in the City of Dellwood; for the project
known as West Florissant & Chambers (Walgreen’s – 10000 W. Florissant); P-0027971-00.
WHEREAS, the owners of the subject properties have requested this District to
vacate any right, title, or interest that the District may have in said subject easement and said
portion of easement, and this District has no further use for said easement and portion of
easement,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. Any rights, title or interest of the District in the variable width
easement as recorded in Deed Book 3887, Page 56 located in said part of Lots 1 and 2 of
Dellwood Retail Resubdivision Plat in the Southwest Quarter of Section 6, Township 46 North,
Range 7 East as shown hachured on the attached “Easement Vacation Plat”, and marked Exhibit
“A-1” and made a part hereof, is hereby vacated.
Section Two. The portion of the ten (10’) foot wide easement as recorded in Deed
Book 8857, Page 2473 and also recorded in Deed Book 8857, Page 2476 located in said part of
Lots 1 and 2 of Dellwood Retail Resubdivision Plat in the Southwest Quarter of Section 6,
Township 46 North, Range 7 East as show hachured on the attached “Easement Vacation Plat”,
and marked Exhibit “A-2” and made a part hereof, is hereby vacated.
The foregoing Ordinance was adopted December 10, 2009.
