HomeMy Public PortalAbout13007ORDINANCE NO. 13007 AN ORDINANCE, declaring the necessity for the acquisition of real property within The Metropolitan St. Louis Sewer District for the purpose of purchasing property due to inadequate storm and sanitary sewers for the project known as Harlem – Baden Relief Phase IV (Herbert Acquisition) (2003039A) to serve the needs of residents of the area, and authorizing the acquisition of said real property by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area in the City of St. Louis within the Bissell Point Area Watershed wherein live and work numerous people; and WHEREAS, storm water and sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain real property for the construction of a detention basin in the project known as Harlem – Baden Relief Phase IV (Herbert Acquisition) (2003039A) as hereinafter set forth, said real property being more particularly described below: Harlem – Baden Relief Phase IV (Hebert Acquisition) M.S.D. Project No. 2003039A Parcel No. 47 LOT 25 IN BLOCK 1 OF MARS PLACE ADDITION, AND IN BLOCK 5239 OF THE CITY OF ST. LOUIS, FRONTING 35 FEET ON THE WESTERN LINE OF BLACKSTONE AVENUE BY A DEPTH WESTWARDLY BETWEEN PARALLEL LINES OF 125 FEET TO AN ALLEY. Harlem – Baden Relief Phase IV (Hebert Acquisition) M.S.D. Project No. 2003039A Parcel No. 14 PART OF LOTS NOS. 6 AND 7 IN BLOCK NO. 3 OF MARS PLACE ADDITION, AND IN BLOCK NO. 4360 OF THE CITY OF ST. LOUIS, BEGINNING AT A POINT IN THE NORTH LINE OF HEBERT STREET 12 FEET 7-3/8 INCHES EAST OF THE SOUTHWEST CORNER OF SAID LOT NO. 6, THENCE WESTWARDLY ALONG THE NORTH LINE OF HEBERT STREET 46 FEET 4- 3/4 INCHES TO A POINT 1 FOOT 2-5/8 INCHES EAST OF THE SOUTHWEST CORNER OF LOT NO. 7, THENCE NORTHWARDLY IN A STRAIGHT LINE 119 FEET 5 INCHES TO A POINT IN THE SOUTH LINE OF AN ALLEY WHICH POINT IS 1 FOOT 1/8 INCHES EAST OF THE NORTHWEST CORNER OF LOT NO. 7, THENCE EASTWARDLY ALONG THE SOUTH LINE OF SAID ALLEY 39 FEET 7-1/4 INCHES TO A POINT 10 FEET 10 INCHES EAST OF THE NORTHWEST CORNER OF LOT NO. 6, THENCE SOUTHWARDLY 112 FEET 10-3/8 INCHES TO THE POINT OF BEGINNING. Section Two. Counsel for The Metropolitan St. Louis Sewer District is hereby authorized to enter into contracts to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing Ordinance was adopted December 10, 2009.
