AN ORDINANCE, appropriating Two Million Five Hundred Thousand
($2,500,000.00) from the Sanitary Replacement Fund to be used for project costs for the
construction of sanitary sewers in FF-08 Fee Fee Creek Sanitary Relief Phase II (89137A), in the
City of Maryland Heights, Missouri; and authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into a contract with
Fred M. Luth & Sons, Inc. for the aforesaid sanitary sewer construction.
WHEREAS, the bid for said sanitary sewer construction is Two Million Two
Hundred Sixty-Five Thousand Eight-Six Dollars ($2,265,086.00) and the allowance for
construction change orders and other project expenses is Two Hundred Thirty-Four Thousand
Nine Hundred Fourteen Dollars ($234,914.00), and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Two Million Five Hundred Thousand ($2,500,000.00)
is hereby appropriated from the Sanitary Replacement Fund to be used for project costs for the
construction of sanitary sewers in FF-08 Fee Fee Creek Sanitary Relief Phase II (89137A), in the
City of Maryland Heights, Missouri.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into a contract with
Fred M. Luth & Sons, Inc. as the lowest responsible bidder for the construction of sanitary
sewers in FF-08 Fee Fee Creek Sanitary Relief Phase II (89137A), in the City of Maryland
Heights, Missouri, pursuant to bids received and opened on the 20th day of November 2009.
Section Three. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing Ordinance was adopted January 14, 2010.
