HomeMy Public PortalAbout13029ORDINANCE NO. 13029 AN ORDINANCE, vacating a portion of a variable width easement as recorded in Deed Book 8390, Page 1363; and any rights, title, or interest of the District in a portion of a variable width roadway & utility easement & parking reservation, also any rights, title, or interest of the District in a portion of a ten (10’) foot wide utility easement and a portion of a seven (7’) foot wide utility easement according to the plat thereof recorded in Plat Book 235, Page 46; and any rights, title or interest of the District in a portion of a variable width roadway & utility easement & parking reservation according to the plat thereof recorded in Plat Book 286, Pages 25-26 and located in Adjusted Lot A of A Boundary Adjustment Plat of Part of “The Valley Center”, Share 7 of the Peter Steffan Estate, Lot 4 of a Subdivision of the West Half of U.S. Survey 126, Township 45 North, Range 4 East, according to the plat thereof recorded in Plat Book 349, Page 493 of the St. Louis County Records, in the City of Chesterfield, Missouri; for the project known as Valley Center Plat 4 (St. Louis Family Church); P-0019682-05. WHEREAS, the owners of the subject property have requested this District to vacate a portion of the subject easement and any rights, title, or interest that the District may have in said portions of the roadway & utility easement & parking reservations and said portions of the utility easements, and this District has no further use for said portion of easement and portions of roadway & utility easement & parking reservations and portions of utility easements, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The portion of the variable width easement as recorded in Deed Book 8390, Page 1363, located in said Adjusted Lot A of A Boundary Adjustment Plat of Part of  The Valley Center , Share 7 of the Peter Steffan Estate, Lot 4 of a Subdivision of the West Half of U.S. Survey 126, Township 45 North, Range 4 East as shown hachured on the attached  Easement Vacation Plat , and marked Exhibit  A-1 and made a part hereof, is hereby vacated. Section Two. Any rights, title or interest of the District in the variable width roadway & utility easement & parking reservation, and any rights, title, or interest of the District in a portion of a ten (10 ) foot wide utility easement and a portion of a seven (7 ) foot wide utility easement according to the plat thereof recorded in Plat Book 235, Page 46, also any rights, title or interest of the District in the variable width roadway & utility easement & parking reservation according to the plat thereof recorded in Plat Book 286, Pages 25-26, located in said Adjusted Lot A of A Boundary Adjustment Plat of Part of  The Valley Center , Share 7 of the Peter Steffan Estate, Lot 4 of a Subdivision of the West Half of U.S. Survey 126, Township 45 North, Range 4 East as shown hachured on the attached  Easement Vacation Plat , and marked Exhibit  A-2 and made a part hereof, is hereby vacated. The foregoing Ordinance was adopted January 14, 2010.
