AN ORDINANCE, authorizing the transfer of funds to the Sanitary Replacement
Fund from the following funds in the amounts listed: Operation, Maintenance and Construction
Improvement Fund of Clayton Central – One Hundred Ninety Thousand Dollars ($190,000.00);
and Operation, Maintenance and Construction Improvement Fund of Fountain Creek – Thirty
Thousand Dollars ($30,000.00); and Operation, Maintenance and Construction Improvement
Fund of Upper Paddock Creek – Thirty Thousand Dollars ($30,000.00); and Operation,
Maintenance and Construction Improvement Fund of Wedgewood Creek – Forty Five Thousand
Dollars ($45,000.00); and appropriating Five Million One Hundred Thousand Dollars
($5,100,000.00) from the Sanitary Replacement Fund to be used for project costs for the
rehabilitation of sanitary sewers in Infrastructure Repairs (Rehabilitation) (FY2010) (Phase A)
(2009064A) in the City of St. Louis and St. Louis County, Missouri; and authorizing the
Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer
District to enter into a contract with SAK Construction, LLC for the rehabilitation of the
aforesaid sanitary sewers.
WHEREAS, the bid for the rehabilitation of said sanitary sewers is Four Million
Eight Hundred Twenty-Seven Thousand Six Hundred Thirty-Seven and 05/100 Dollars
($4,827,637.05), and the allowance for construction change orders and other project costs is Four
Hundred Seventy Two Thousand Three Hundred Sixty-Two and 95/100 Dollars ($472,362.95),
and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named funds sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The following funds are hereby transferred to the Sanitary
Replacement Fund from the following funds in the amounts listed: Operation, Maintenance and
Construction Improvement Fund of Clayton Central – One Hundred Ninety Thousand Dollars
($190,000.00); and Operation, Maintenance and Construction Improvement Fund of Fountain
Creek – Thirty Thousand Dollars ($30,000.00); and Operation, Maintenance and Construction
Improvement Fund of Upper Paddock Creek – Thirty Thousand Dollars ($30,000.00); and
Operation, Maintenance and Construction Improvement Fund of Wedgewood Creek – Forty Five
Thousand Dollars ($45,000.00).
Section Two. The sum of Five Million One Hundred Thousand Dollars
($5,100,000.00) is hereby appropriated from the from the Sanitary Replacement Fund to be used
for project costs for the rehabilitation of sanitary sewers in Infrastructure Repairs (Rehabilitation)
(FY2010) (Phase A) (2009064A) in the City of St. Louis and St. Louis County, Missouri
Section Three. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into a contract with
SAK Construction, LLC as the lowest responsible bidder for the rehabilitation of sanitary sewers
in Infrastructure Repairs (Rehabilitation) (FY2010) (2009064A) in the City of St. Louis and
St. Louis County, Missouri, pursuant to bids received and opened on the 1st day of December
2009.
Section Four. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing Ordinance was adopted February 11, 2010.
