AN ORDINANCE, making a supplemental appropriation of Six Hundred Fifty-
Four Thousand Dollars ($654,000.00) from funds being liquidated from an appropriation under
Ordinance No. 11964, adopted April 14, 2005, to the Caulks Creek Construction Fund to be used
for additional project costs for the construction of Infrastructure Repair #087P Caulks Creek “A”
(P-750) Phase IV - Section B (93077C1), in the City of Chesterfield, Missouri; and authorizing
the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer
District to enter into a contract amendment with Gershenson Const. Co., Inc. for the aforesaid
additional project costs.
WHEREAS, Ordinance No. 12860, adopted June 11, 2009, appropriated the
initial funding for and authorized the contract for said project, and
WHEREAS, Ordinance No. 11964, adopted April 14, 2005, appropriated the
initial funding for the acquisition of easements to serve the Caulks Creek Force Main
Infrastructure Repair #087P Caulks Creek “A” (P-750) Phase IV – Section B, and
WHEREAS, Easement acquisition is complete and $654,000.00 remains appropriated
under Ordinance No. 11964, adopted April 14, 2005, and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED, BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Six Hundred Fifty-Four Dollars ($654,000.00) is hereby
liquidated from the funds appropriated under Ordinance No. 11964, adopted April 14, 2005, to
the Caulks Creek construction Fund.
Section Two. The sum of Six Hundred Fifty-Four Thousand Dollars
($654,000.00) is hereby appropriated from the Caulks Creek Construction Fund to be used for
additional project costs for the construction of Infrastructure Repair #087P Caulks Creek “A”
(P-750) Phase IV - Section B (93077C1), in the City of Chesterfield, Missouri.
Section Three. The Executive Director and Secretary-Treasurer are hereby authorized on
behalf of The Metropolitan St. Louis Sewer District to enter into a contract amendment with
Gershenson Const. Co., Inc. for additional project costs for the construction of Infrastructure
Repair #087P Caulks Creek “A” (P-750) Phase IV - Section B (93077C1), in the City of
Chesterfield, Missouri; said contract amendment to be comprised of such terms and conditions as
are approved by the Office of General Counsel of the District.
Section Four. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
