HomeMy Public PortalAbout13066O RDINANCE NO. 13066 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer to lease certain real property of The Metropolitan St. Louis Sewer District, lying in St. Louis County, Missouri, to Pro Am South L.L.C., and to execute a Lease Agreement upon the conditions hereinafter set out. WHEREAS, The Metropolitan St. Louis Sewer District hereinafter called Lessor, has acquired certain real property in St. Louis County, Missouri, incident to its public functions and responsibilities, said property being for Open Space Purposes, and WHEREAS, Pro Am South LLC, desires to lease from Lessor a portion of said real property to be used in conjunction with a Golf Driving Range it owns in conjunction with the general terms as hereafter set forth, and WHEREAS, the execution of said lease will not interfere with the Open Space Purposes for which said real property was acquired. WHEREAS, the lease between MSD and Thomas DeGrande d/b/a Pro Am South, approved by Ordinance 9849, adopted April 18, 1996, is hereby terminated as of April 30, 2010, by mutual agreement of the parties NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby lease to Pro Am South L.L.C., upon the general terms and conditions hereinafter set forth, the following described real property: The northwest 150 feet of a tract in Lots 13 and 14 of Carondelet Commons which was acquired by deed recorded in Book 6774, Page 24 of the County records. Said 150 foot parcel being bounded southwest by a line, perpendicular to the northwest line of tract acquired in deed aforesaid, and being 575 feet (measured along said northwest line) southwest of the south line of the Missouri Pacific Railway right-of- way. Section Two. The lease term shall commence on May 1, 2010 and continue for two (2) years to April 30, 2012, at the rental of Three Hundred Twenty-five Dollars ($325.00) per month, with two five year options covering the period of May 1, 2012 to April 30, 2017 and May 1, 2017 to April 30, 2022 respectively upon the same terms and conditions with the sole exception that if Pro Am South L.L.C. exercises the second option from May 1, 2017 to April 30, 2022, the monthly rent shall be Three Hundred Fifty Dollars ($350.00) per month. Section Three. The Executive Director and Secretary-Treasurer are hereby authorized to execute in behalf of the District a Lease Agreement giving effect to Sections One and Two hereof, and embodying such other general terms and conditions as are approved by the General Counsel of the District. The foregoing Ordinance was adopted April 8, 2010.
