HomeMy Public PortalAbout13206ORDINANCE NO. 13206 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer to lease certain real property of The Metropolitan St. Louis Sewer District, lying in the City of St. Louis, Missouri, to the Walgreen Company for use as a parking lot and to execute a Lease Agreement upon the conditions hereinafter set out. WHEREAS, The Metropolitan St. Louis Sewer District hereinafter called Lessor, owns certain real property in the City of St. Louis, Missouri which it has been leasing to Walgreen Company for use as a parking lot pursuant to an expired lease authorized and executed under a previous Ordinance No. 10085 adopted the 5th of August, 1997; and WHEREAS, the Walgreen Company, desires to lease from Lessor a portion of said real property to be used as part of its parking lot, and WHEREAS, The Metropolitan St. Louis Sewer District is willing to enter into such a lease, and believes it to be advantageous and in the public interest to do so. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby lease to Walgreen Company, upon the general terms and conditions hereinafter set forth, the following described real property: A parcel of land in Outlot No. 65 of the City of St. Louis, MO, and more particularly described as follows: Beginning at the southernmost corner of property conveyed to Ivan Lusicic and wife by deed recorded in Book 6399, Page 191, City of St. Louis, MO, Recorder’s office, said point being in the northwest line of Gravois Avenue, 80’ wide at it intersection with a line parallel to, and 10’ northeasterly from, measured at right angles to, the northeast line of the River des Peres Drainage Works right-of-way, 270’ wide; thence northwesterly along the southwest line of said Lusicic property, and that of Parcel No. 2 of property conveyed to Grav-Hamp Corporation, by deed recorded in Book 7821, Page 140, said Recorder’s office, and being along said parallel line, 282.67’ to the westernmost corner of said Parcel No. 2 of said Grav-Hamp Corporation property; thence southwesterly along the southwestern prolongation of the northwest line of said Grav-Hamp (Parcel No. 2) property, 50’ more or less to the top edge of the rip-rap on the northeast bank of said Drainage Works; thence southeasterly along said edge of said rip-rap, 285’ more or less to the northwest line of said Gravois Avenue; and thence northeasterly along said street line, 50’ more or less to the beginning. Section Two. The lease term shall commence on November 1, 2010 and continue for twenty (20) years to October 31, 2030: at the rental of Three Hundred ($300.00) per month for ten years from November 1, 2010 and continuing to and including October 31, 2020; the rental of Three Hundred Twenty-five Dollars ($375.00) per month for five years from November 1, 2020 and continuing to and including October 31, 2025; the rental of Four Hundred and Fifteen Dollars ($415.00) per month for five years from November 1, 2025 and continuing to and including October 31, 2030; with two five year options covering the period of November 1, 2030 to October 31, 2035 and November 1, 2035 to October 31, 2040 respectively upon the same terms and conditions with the sole exception that if Walgreen Company exercises the first option from November 1, 2030 to October 31, 2035, the monthly rent shall be Four Hundred Thirty-Five Dollars ($435.00) per month; and if Walgreen Company exercises the second option from November 1, 2035 to October 31, 2040, the monthly rent shall be Four Hundred Sixty Dollars ($460.00) per month. Section Three. The Executive Director and Secretary-Treasurer are hereby authorized to execute in behalf of the District a Lease Agreement giving effect to Sections One and Two hereof, and embodying such other general terms and conditions as are approved by the Office of General Counsel of the District.
