HomeMy Public PortalAbout13260O RDI NANCE NO. 13260 AN ORDINANCE to extend the boundaries of The Metropolitan St. Louis Sewer District to include an area of St. Louis County which could be efficiently served by the sewer or drainage facilities of the Metropolitan St. Louis Sewer District and WHEREAS, petitions signed by a majority of the owners of the land in said area, who are also the owners of more than one-half of the land area therein, praying for annexation of said area by the Metropolitan St. Louis Sewer District and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of the Metropolitan St. Louis Sewer District; and WHEREAS, this area adjoins The Metropolitan St. Louis Sewer District, and that the interests of sanitation and public health of the District will be promoted by including the area in their respective territories; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. That the board finds that the sewer or drainage facilities of the District can efficiently serve the area described in Exhibit A, as attached hereto. Section Two. That petitions signed by a majority of the owners of the land in said area, who are also the owners of more than one-half of the land area therein, praying for annexation of said area by the Metropolitan St. Louis Sewer District and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of The Metropolitan St. Louis Sewer District. Section Three. That the interests of sanitation and public health of the District, as well as the area proposed to be annexed, will be promoted by including said area in their respective territories. Section Four. That the sewage flow from the area proposed to be annexed has no other available adequate sewer outlet or treatment facility. Section Five. That the Board of Trustees, after examination and consideration of the facts, hereby grants the petition for annexation of said area, and hereby declares that the corporate boundaries of the Metropolitan St. Louis Sewer District are hereby respectively extended so as to include the area described in Exhibit A, as attached hereto. Section Six. Certified copies of this Ordinance shall be filed in the offices of the Recorder of Deeds of St. Louis County, the Recorder of Deeds of the City of St. Louis and the Secretary of State. The foregoing Ordinance was adopted June 9, 2011. Exhibit A Tracts of land being the properties of Wesley J. Byrne by instruments recorded in Deed Book 16452, Page 1165, Deed Book 16452, Page 1200 and Deed Book 16493, Page 3086 of the St. Louis County, Missouri records; of Shawna G. Byrne by instrument recorded in Deed Book 17128, Page 3694 of said records; of Claymont Development, LLC by instrument recorded in Deed Book 16499, Page 669 of said records; and part of the west half of Missouri State Highway 109, A.K.A. Eatherton Road (width varies), all located in the Southeast Quarter of Section 35 and the Southwest Quarter of Section 36, Township 45 North, Range 3 East of the Fifth Principal Meridian, St. Louis County, Missouri and being more particularly described as follows: Beginning at the intersection of the centerline of above said Highway 109 and the centerline of Babler View Drive (70 feet wide); thence along the centerline of said Highway 109, South 12 degrees 15 minutes 00 seconds West, 6.28 feet to a point on the prolongation of the south line of above said Wesley J. Byrne (16452/1200) tract; thence leaving said centerline and along said south line, North 83 degrees 15 minutes 00 seconds West, 1053.01 feet to the southwest corner of last said Byrne tract; thence leaving said south line and along the west line of last said Byrne tract and its prolongation, said prolongation being the west line of above said Wesley J. Byrne (16452/1165) tract, North 09 degrees 51 minutes 00 seconds East, 250.37 feet to the southwest corner of above said Claymont Development tract; thence leaving last said west line and along the west line of said Claymont Development tract the following courses and distances: North 25 degrees 34 minutes 00 seconds East, 294.80 feet; North 00 degrees 23 minutes 00 seconds West, 123.89 feet; and North 29 degrees 08 minutes 00 seconds East, 136.93 feet to the northwest corner of said Claymont Development tract; thence leaving last said west line and along the north line of said Claymont Development tract, South 89 degrees 24 minutes 00 second East, 384.53 feet to a point on the east line of above said Section 35; thence leaving last said north line and along said east line of Section 35, South 00 degrees 55 minutes 00 seconds East, 60.33 feet to the northwest corner of above said Shawna G. Byrne tract; thence leaving last said east line and along the north line of said Shawna G. Byrne tract and its prolongation, North 89 degrees 59 minutes 00 seconds East, 504.02 feet to a point on said centerline of Highway 109; thence leaving last said north line and along last said centerline, along a curve to the right whose radius point bears South 81 degrees 14 minutes 36 seconds West, 1432.69 feet and whose chord bears South 01 degrees 37 minutes 45 seconds West, 516.56 feet, an arc distance of 519.40 feet to a point of tangency; thence continuing along last said centerline, South 12 degrees 15 minutes 00 seconds West, 300.02 feet to the Point of Beginning. The above described tracts are a compilation of St. Louis County, Missouri public records and contain 18.449 acres, more or less, and are subject to all easements, restrictions, reservations and conditions of record, if any, and to the results of an accurate boundary survey.
