AN ORDINANCE, declaring the necessity for the acquisition of easements and
temporary easements in certain real property within The Metropolitan St. Louis Sewer District
for the purpose of construction of sewers and related appurtenances in the project known as
McKelvey Project “A” & “B” Sanitary Relief (SKME-005) 10163 – 2006122 to serve the needs
of residents of the area, and authorizing the acquisition of said easements and temporary
construction easements by purchase or by the institution of condemnation proceedings.
WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area
of the County of St. Louis within the Fee Fee Creek Watershed wherein live and work numerous
people; and
WHEREAS, sewage gathered from such area will have no adequate means of
disposition, and will constitute a menace to public health and welfare of the general public and
the residents of The Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer
District to protect the public health and welfare by construction, reconstruction, maintenance or
repair of sewers and related appurtenances on, over and across said area in order to relieve and
alleviate these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve dangerous
conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or
otherwise easements and temporary construction easements in real property for the construction
of sewers and related appurtenances in the project known as McKelvey Project “A” & “B”
Sanitary Relief (SKME-005) 10163 – 2006122 as hereinafter set forth, said easements and
temporary easements being more particularly described below:

A 10.00 FOOT WIDE EASEMENT across Lot 31 of Grandview Hills as recorded in Plat Book
72 Page 15 of the St. Louis County, Missouri Recorder’s Office and being more particularly
described as follows:
COMMENCING at the western corner of said Lot 31; THENCE North 63 degrees 50 minutes 09
seconds East along the northwestern line of said Lot 31 said northwestern line also being the
southeastern line of Lot 30 in said Grandview Hills a distance of 58.00 feet to the Point of
Beginning of the centerline of herein described 10.00 FOOT WIDE EASEMENT; THENCE
South 26 degrees 43 minutes 50 seconds East a distance of 15.33 feet to a point; THENCE South
48 degrees 12 minutes 33 seconds East a distance of 114.12 feet to a point; THENCE South 47
degrees 08 minutes 38 seconds East a distance of 3.12 feet to the Point of Termination of the
centerline of herein described 10.00 FOOT WIDE EASEMENT, said Point of Termination also
being North 48 degrees 59 minutes 23 seconds East along the southeastern line of said Lot 31 a
distance of 62.24 feet from the southern corner of said Lot 31, excepting there from those
portions covered by the existing easements recorded in said Plat Book 72 Page 15 and Plat Book
97 Page 88 of said Recorder’s Office.
Also, two (2) 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENTS NO. 1 and
NO.2 for use during the construction of any sewer in the above described 10.00 FOOT WIDE
EASEMENT and being more particularly described as follows:
A 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT NO.1 lying adjacent and
parallel to the eastern sides of above described 10.00 FOOT WIDE EASEMENT, bounded on
the northwest by the said northwestern line of Lot 31 and bounded on the southeast by the said
southeastern line of Lot 31, excepting there from those portions covered by the existing
easements recorded in said Plat Book 72 Page 15 and Plat Book 97 Page 88 of said Recorder’s
Office.
A 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT NO.2 lying adjacent and
parallel to the western sides of above described 10.00 FOOT WIDE EASEMENT, bounded on
the northwest by the said northwestern line of Lot 31 and bounded on the southeast by the said
southeastern line of Lot 31, excepting there from those portions covered by the existing
easements recorded in said Plat Book 72 Page 15 and Plat Book 97 Page 88 of said Recorder’s
Office.
The two (2) 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENTS NO. 1 and

northern right of way line of Adie (variable width) Road; THENCE North 27 degrees 49 minutes
21 seconds West along the southwestern line of a tract of land conveyed to Peter L. Ballenger by
deed recorded in Deed Book 10340 Page 1075 of said Recorder’s Office a distance of 65.56 feet

parallel to each side of above described 10.00 FOOT WIDE EASEMENT, bounded on the
northwest by the said southeastern line of Common Ground in Pinehurst Place Plat Two and
bounded on the southeast by the said southwestern line of a tract of land conveyed to Peter L.
Ballenger and said southwestern line of a tract of land conveyed to Bruce F. Buwalda and

covered by the existing easements recorded in said Plat Book 150 Page 63 and Deed Book 3813
Page 562 of said Recorder’s Office.
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT NO.2 lying adjacent to
the western side of above described 10.00 FOOT WIDE EASEMENT, bounded on the northwest
by the said northwestern line of “Midland Apartments Plat One” and bounded on the southwest
by the said northeastern line of Common Land, excepting there from those portions covered by
the existing easement recorded in said Deed Book 3813 Page 562 of said Recorder’s Office.
The 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT NO.1 and
VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT NO.2 will become null
and void upon completion of the above described sewer construction.
Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is
hereby authorized to enter into contracts to acquire by purchase if possible, or to institute and
prosecute an action in condemnation pursuant to the provisions of the Charter of The
Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation
of private property rights as hereinabove set out.
