HomeMy Public PortalAbout13393ORDINANCE NO. 13393 AN ORDINANCE, ratifying a Supplemental Lease Agreement by and between The Metropolitan St. Louis Sewer District and the United States of America extending through March 31, 2014, the term of the lease of a portion of certain real property of the District known and numbered as 2350 Market Street in the City of St. Louis, Missouri, as leased by the District to the United States of America; and authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into a Supplemental Lease Agreement with the United States of America whereby the District will continue to lease a portion of certain real property of the District, known and numbered as 2350 Market Street in the City of St. Louis, Missouri, to the United States of America for the term of April 1, 2012, through March 31, 2014. WHEREAS, the aforesaid lease of the United States of America was assumed by the District upon the District’s purchase of the real property known and numbered as 2350 Market Street in the City of St. Louis, Missouri, on February 8, 2002, and WHEREAS, said lease was extended previously for the period April 1, 2007 through February 28, 2010, and for two additional one-year option periods through March 31, 2012, and WHEREAS, said lease expired on March 31, 2012, and the District and the United States of America desire to enter into a new lease extension, commencing on April 1, 2012 and terminating on March 31, 2014. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Supplemental Lease Agreement by and between The Metropolitan St. Louis Sewer District and the United States of America extending through March 31, 2014, the term of the lease of a portion of certain real property of the District known and numbered as 2350 Market Street in the City of St. Louis, Missouri, as leased by the District to the United States of America, is hereby ratified. Section Two. The lease term shall commence on April 1, 2012 and continue for two (2) years to March 31, 2014, at the rental of Twelve Thousand, One Hundred and Twenty Five Dollars and 31 Cents ($12,125.31) per month. Section Three. The Executive Director and Secretary-Treasurer are hereby authorized to execute in behalf of the District a Supplemental Lease Agreement giving effect to Sections One and Two hereof, and embodying such other general terms and conditions as are approved by the General Counsel of the District. Section Four. The Lease Agreement as previously authorized for the aforesaid District real property has expired, and it is critical that the Supplemental Lease Agreement be implemented without delay, thus creating an emergency within the meaning of the District Charter. Accordingly, this Ordinance shall take effect immediately upon its enactment. The foregoing Ordinance was adopted April 12, 2012.
