HomeMy Public PortalAbout13407O RDINANCE NO. 13407 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer to lease certain real property of The Metropolitan St. Louis Sewer District, lying in St. Louis County, Missouri, to Kadima Properties, LLC, and to execute a Lease Agreement upon the conditions hereinafter set out. WHEREAS, The Metropolitan St. Louis Sewer District, hereinafter called Lessor, owns certain real property in St. Louis County, Missouri, incident to its public functions and responsibilities, and said property is being held for Open Space Purposes, and WHEREAS, Pro Am South LLC has leased from Lessor a portion of said real property in conjunction with a Golf Driving Range it operated, and WHEREAS, Pro Am South LLC elected not to extend its lease with Lessor, and WHEREAS, the adjacent property owner, Kadima Properties, LLC, desires to lease the Pro-Am property on the same terms as the Pro-Am lease and to operate itself or to locate an operator of the Golf Driving Range, and WHEREAS, the execution of said lease with Kadima Properties will not interfere with the Open Space Purposes for which said real property was acquired. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby lease to Kadima Properties, LLC, upon the general terms and conditions hereinafter set forth, the following described real property: The northwest 350 feet of a tract in Lots 13 and 14 of Carondelet Commons which was acquired by deed recorded in Book 6774, Page 24 of the County records. Said 350 foot parcel being bounded southwest by a line, perpendicular to the northwest line of tract acquired in deed aforesaid, and being 575 feet (measured along said northwest line) southwest of the south line of the Missouri Pacific Railway right-of-way. Section Two. The lease term shall commence on July 1, 2012 and continue for three (3) years to June 30, 2015, at the rental of Three Hundred Twenty-five Dollars ($325.00) per month, with a one (1) year option covering the period of July 1, 2015 to June 30, 2016 respectively upon the same terms and conditions. Section Three. The Executive Director and Secretary-Treasurer are hereby authorized to execute in behalf of the District a Lease Agreement giving effect to Sections One and Two hereof, and embodying such other general terms and conditions as are approved by the Office of General Counsel of the District. The foregoing Ordinance was adopted June 14, 2012.
