AUTHORIZING TAX ASSESSOR TO FILE COUNTERCLAIMS
ON BEHALF OF THE BOROUGH OF CARTERET
WHEREAS, various taxpayers file property assessment appeals from time to time; and
WHEREAS, the Assessor of the Borough of Carteret (tire `Borough") believes there is a
reasonable basis for the filing of counterclaims on behalf of the Borough with regard to
the same; and
WHEREAS, the statute authorizing such counterclaims specifically requires
administrative action by the municipality's Governing Body to authorize the Tax
Assessor to file said counterclaims; and
WHEREAS, similarly the Tax Assessor believes there is an additional basis to file direct
tax appeals with regard to certain properties.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough
of Carteret that the Tax Assessor is hereby authorized to file such counterclaims and
direct tax appeals as permitted by the Rules of the Court with the assistance of legal
counsel in conjunction with the Borough Law Director.
