AN ORDINANCE, repealing Ordinance No. 13547, adopted January 10, 2013,
and enacting a new Ordinance in lieu thereof, appropriating Four Hundred Ten Thousand Dollars
($410,000.00) from the Sanitary Replacement Fund to be used for sanitary sewer construction at
Tiemann & Nonie Ave. Sanitary Sewer Replacement (10775), in Unincorporated St. Louis
County, Missouri; and authorizing the Executive Director and Secretary-Treasurer on behalf of
The Metropolitan St. Louis Sewer District to enter into Contract No. 11001 with XL Contracting,
Inc. for the construction of the aforesaid sewers.
WHEREAS, Ordinance No. 13547, adopted January 10, 2013, appropriated the
initial funding for and authorized a contract, and
WHEREAS, the bid for the sanitary sewer construction is Three Hundred Sixty
Three Thousand Four Hundred Seventy-Six and 77/100 Dollars ($363,476.77) and the allowance
for change orders and other project costs is Forty Six Thousand Five Hundred Twenty Three and
23/100 Dollars ($46,523.23), and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. Ordinance No. 13547, adopted January 10, 2013, is hereby
repealed.
Section Two. The sum of Four Hundred Ten Thousand Dollars ($410,000.00) is
hereby appropriated from the Sanitary Replacement Fund to be used for sanitary sewer
construction at Tiemann & Nonie Ave. Sanitary Sewer Replacement (10775), in Unincorporated
St. Louis County, Missouri.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into Contract
No. 11001 with XL Contracting, Inc. as the lowest responsible bidder for the sanitary sewer
construction at Tiemann & Nonie Ave. Sanitary Sewer Replacement (10775), in Unincorporated
St. Louis County, Missouri, pursuant to bids received and opened on the 12th day of October,
2012.
Section Three. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing Ordinance was adopted July 11, 2013.
