HomeMy Public PortalAbout13717ORDINANCE NO. 13717 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer to lease certain real property of The Metropolitan St. Louis Sewer District, lying in the City of St. Louis, Missouri consisting of a rectangular-shaped parcel located in the northernmost corner of the Bissell Treatment Plant property, adjacent to property of Archer-Daniels-Midland Company (ADM Company) and bounded by East Prairie Street, and to execute a Lease Agreement upon the conditions hereinafter set out. WHEREAS, The Metropolitan St. Louis Sewer District owns certain real property in the City of St. Louis, Missouri, incident to its public functions and responsibilities, said property being a rectangular shaped parcel along East Prairie Street and adjacent to the Sligo property within the Bissell Treatment Plant property, St. Louis, Missouri, and WHEREAS, ADM Company operates a grain distribution operation along the Mississippi River and ADM is desirous of leasing said real property to be used as a staging area for grain trucks waiting to be unloaded, and WHEREAS, The Metropolitan St. Louis Sewer District is not using the rectangular tract of land and has no current plans to use the rectangular tract of land, and WHEREAS, The Metropolitan St. Louis Sewer District is willing to enter into such lease with ADM and believes it to be advantageous and in the public interest to do so. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby lease to ADM Company, upon the general terms and conditions hereinafter set forth, the real property consisting of approximately 3.4 acres in a rectangular shape located in the northern corner of the Bissell Treatment Plant property in the City of St. Louis, Missouri. Section Two. The lease term shall commence on October 1, 2013 and shall continue for a period of ten (10) years, to September 30, 2023, at the annual rental of Seventy- Five Hundred Dollars ($7,500) with three (3), five-year options to renew the lease upon the same terms and conditions, with rent increasing by five per cent (5%) for each renewal term. The Metropolitan St. Louis Sewer District may terminate the lease at any time upon notice in the event it needs the property for its operations. Section Three. The Executive Director and Secretary-Treasurer are hereby authorized to execute on behalf of the District a Lease Agreement giving effect to Sections One and Two hereof, and embodying such other general terms and conditions as are approved by the office of the General Counsel of the District. The foregoing Ordinance was adopted on September 12, 2013.
