HomeMy Public PortalAbout13825ORDINANCE NO. 13825 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as CSO - Gingras Creek and I/I Reduction (BP-059) (11730) to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of the County of St. Louis in various municipalities within the Baden Watershed wherein live and work numerous people; and WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Parcel #24 A 10.00 FOOT WIDE EASEMENT across Lot 23 in Block 13 of Section Two of Pasadena Hills as recorded in Plat Book 27, Page 43 of the St. Louis County Recorder’s Office being more particularly described as follows: COMMENCING at the southwestern corner of said Lot 23, said southwestern corner also being on the east line of a 10.00 foot wide Walkway as recorded in said Plat Book 27, Page 43; THENCE North 05 degrees 35 minutes 48 seconds West along the west line of said Lot 23, said west line also being the said east line of a 10.00 foot wide Walkway a distance of 142.08 feet to the POINT OF BEGINNING of the center line of herein described 10.00 FOOT WIDE EASEMENT; THENCE North 44 degrees 22 minutes 41 seconds East along said centerline a distance of 30.34 feet to a point; THENCE North 04 degrees 35 minutes 47 seconds West a distance of 5.66 feet to the POINT OF TERMINATION of herein described 10.00 FOOT WIDE EASEMENT, said POINT OF TERMINATION being on the northern line of said Lot 23, said northern line also being the southern right-of-way line of Country Club (100.00 foot) Drive. The two (2) TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above described construction. Parcel #26 A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT being part of Lot 1of Bentwood as recorded in Plat Book 350, Pages 258 and 259 of the St. Louis County, Missouri Recorder’s Office and being more particularly described as follows: BEGINNING at the northeastern corner of said Lot 1of Bentwood, said northeastern corner of Lot 1 also being the southern corner of Adjusted Lot 2 of Boundary Adjustment Plat of Lots 2 & 3 of Bentwood as recorded in Plat Book 351, Page 341 of said Recorder’s Office; THENCE South 29 degrees 36 minutes 14 seconds West along the eastern line of said Lot 1, said eastern line also being the western line of Block 2 of Country Club Hills Addition Plat 2 as recorded in Plat Book 40, Page 50 of said St. Louis County, Missouri Recorder’s Office a distance of 43.74 feet to a point; THENCE North 60 degrees 53 minutes 45 seconds West a distance of 90.07 feet to a point; THENCE North 29 degrees 06 minutes 15 seconds East a distance of 21.60 feet to a point; THENCE North 81 degrees 34 minutes 14 seconds East along the northwestern line of said Lot 1 a distance of 6.17 feet to a point of curvature; THENCE along the northern line of said Lot 1a distance of 59.69 feet along a curve to the right having a radius of 90.00 feet and a chord bearing of South 79 degrees 25 minutes 45 seconds East to a point; THENCE South 60 degrees 25 minutes 46 seconds East along the northern line of said Lot 1 a distance of 30.00 feet to the POINT OF BEGINNING, excepting therefrom those portions covered by the existing easements recorded in Plat Book 351, Page 383 and Deed Book 6373, Page 1286. The TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of above described construction. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing Ordinance was adopted on May 8, 2014.
