HomeMy Public PortalAbout13875O RDI NANCE NO. 13875 AN ORDINANCE to extend the boundaries of The Metropolitan St. Louis Sewer District to include an area of St. Louis County which could be efficiently served by the sewer or drainage facilities of the Metropolitan St. Louis Sewer District and WHEREAS, petitions signed by a majority of the owners of the land in said area, who are also the owners of more than one-half of the land area therein, praying for annexation of said area by the Metropolitan St. Louis Sewer District and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of the Metropolitan St. Louis Sewer District; and WHEREAS, this area adjoins The Metropolitan St. Louis Sewer District, and that the interests of sanitation and public health of the District will be promoted by including the area in their respective territories; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. That the board finds that the sewer or drainage facilities of the District can efficiently serve the area described in Exhibit A, as attached hereto. Section Two. That petitions signed by a majority of the owners of the land in said area, who are also the owners of more than one-half of the land area therein, praying for annexation of said area by the Metropolitan St. Louis Sewer District and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of The Metropolitan St. Louis Sewer District. Section Three. That the interests of sanitation and public health of the District, as well as the area proposed to be annexed, will be promoted by including said area in their respective territories. Section Four. That the sewage flow from the area proposed to be annexed has no other available adequate sewer outlet or treatment facility. Section Five. That the Board of Trustees, after examination and consideration of the facts, hereby grants the petition for annexation of said area, and hereby declares that the corporate boundaries of the Metropolitan St. Louis Sewer District are hereby respectively extended so as to include the area described in Exhibit A, as attached hereto. Section Six. Certified copies of this Ordinance shall be filed in the offices of the Recorder of Deeds of St. Louis County, the Recorder of Deeds of the County of St. Louis and the Secretary of State. The foregoing Ordinance was adopted on July 10, 2014. Exhibit A A tract of land for purposes of describing a proposed area of annexation to the Metropolitan St. Louis Sewer District being comprised of the following tracts of land being now or formerly of the Stephen R Donnell Trust, etal, as recorded in Book 18280, Page 1721; being now or formerly of Patrick M. Gilliam and Rita G. Gilliam, as recorded in Book 8885, Page 529; being now or formerly of Elizabeth Miles, as recorded in Book 14215, Page 1397; being now or formerly of Wildwood Investments, LLC., as recorded in Book 11125, Page 2035 (Parcel 1); being now or formerly of Stephen T. Burgess and Constance M. Burgess, as recorded in Book 10181, Page 720 and being now or formerly of PBMI, LLC., as recorded in Book 20176, Page 4672, as all are recorded in the St. Louis County Office of Recorder of Deeds and all being within parts of Lot 1, 2 and 5 of the partition of The Dreinhoefer Estate, being within Section 2, Township 44 North, Range 3 East, St. Louis County, Missouri with the encompassing boundary of said proposed area of annexation being more particularly described as follows: Beginning at a point being the intersection of the common line of Lot 1 and Lot 2 of “Arnolia Park”, a subdivision, as recorded in Plat Book 192, Page 41 with the North Right of Way line of Manchester Road (formerly 60 feet wide) as all is depicted on said plat of Arnolia Park, said point being also on the current Metropolitan St. Louis Sewer District boundary line as per MSD Odinance No. 12031, to which the herein described tract of land will adjoin, said point being also the TRUE POINT OF BEGINNING herein described tract of land; Thence leaving said North Right of Way line, along said common line of Lot 1 and 2, being also the current boundary of said Metropolitan St. Louis Sewer District, the following courses and distances: North 37 degrees 24 minutes 26 seconds East, a distance of 603.54 feet to a point; thence, South 70 degrees 01 minutes 52 seconds East, a distance of 300.00 feet to a point, said point being on the East line of said Arnolia Park subdivision; thence, along said East line, North 37 degrees 24 minutes 26 seconds East, a distance of 1346.82 feet to a point, said point being the Northeast corner of said Lot 1; thence along the North line of said Lot 1, being also the current boundary of the Metropolitan St. Louis Sewer District, North 89 degrees 08 minutes 06 seconds West, a distance of 931.45 feet to a point, said point being on the North-South centerline of the aforesaid Section 2, said point being also the point of beginning of the herein described proposed MSD Annexation boundary; thence, leaving said current MSD boundary line, along the proposed MSD Annexation boundary line, being also the continuance of the North line of said Lot 1, North 89 degrees 08 minutes 06 seconds West, a distance of 358.98 feet to a point, said point being a Northwest corner of said Lot 1; thence, continuing along the West lines of said Lot 1 and the proposed MSD Annexation boundary line the following courses and distances: South 22 degrees 00 minutes 54 seconds West, a distance of 310.47 feet to a point; thence North 89 degrees 06 minutes 06 seconds West, a distance of 199.96 feet to a point; thence South 00 degrees 16 minutes 54 seconds West, a distance of 595.49 feet to a point; thence North 89 degrees 06 minutes 06 seconds West, a distance of 455.89 feet to a point; thence South 00 degrees 16 minutes 54 seconds West, a distance of 248.4 feet more or less to a point, said point being the intersection of a West line of said Lot 1 with the North line of the tract of land to Wildwood Investments, LLC. as described in the aforesaid Book 11125, Page 2035 (Parcel 1); thence along said North line of said Wildwwod Investments LLC. tract and the North line of the tract of land to Stephen T. Burgess and Constance M. Burgess, as described in the aforesaid Book 10181, Page 720, North 86 degrees 06 minutes 00 seconds West, a distance of 210.3 feet more or less to a point on the centerline of Pond Road (40 feet wide); thence, along said centerline of Pond Road, South 00 degrees 34 minutes 00 seconds West, a distance of 109.4 feet to a point on the centerline on Manchester Road; thence leaving the centerline of Manchester Road, along the centerline of Christy Avenue (40 feet wide), being also the West line of the tract of land to PBMI, LLC. as described in the aforesaid Book 20176, Page 4672 and continuing along the herein proposed MSD Annexation boundary, South 00 degrees 02 minutes 08 seconds West, a distance of 378.8 feet, more or less to the Southwest corner of said tract of Book 20176, Page 4672; thence leaving said centerline, along the South line of said PBMI, LLC. tract, South 89 degrees 21 minutes 52 seconds East, a distance of 208.7 feet, more or less, to the Southeast corner of said PBMI, LLC. tract; thence along the East line of said PBMI, LLC. tract and its Northernly prolongation thereof, North 00 degrees 02 minutes 08 seconds East, a distance of 312.9 feet, more or less, to its point of intersection with the centerline of the aforesaid Manchester Road; thence along said centerline, South 70 degrees 01 minutes 52 seconds East, a distance of 616.8 feet, more or less, to a point of intersection of said centerline with the Southernly prolongation of the aforesaid common line of Lot 1 and Lot 2 of Arnolia Park; thence leaving said centerline, along said prolongation of the common line between Lot 1 and Lot 2, North 37 degrees 24 minutes 26 seconds East, a distance of 36.7 feet, more or less, returning to the point of beginning and the current Metropolitan St. Louis Sewer District boundary line as per MSD Odinance No. 12031.
