AN ORDINANCE, declaring the necessity for the acquisition of easements and
temporary easements in certain real property within The Metropolitan St. Louis Sewer District
for the purpose of construction of sewers and related appurtenances in the project known as
Providence Sanitary Relief (SKME-640) (11700) in the City of Webster Groves, Missouri, to
serve the needs of residents of the area, and authorizing staff to proceed with further
condemnation efforts related to the project, including but not limited to the purchase and/or the
filing of all necessary court pleadings or documents to commence and prosecute formal legal
proceedings for the acquisition of said easements and temporary construction easements.
WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area
of the County of St. Louis within the Deer Creek Watershed wherein live and work numerous
people; and
WHEREAS, sewage gathered from such area will have no adequate means of
disposition, and will constitute a menace to public health and welfare of the general public and
the residents of The Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer
District to protect the public health and welfare by construction, reconstruction, maintenance or
repair of sewers and related appurtenances on, over and across said area in order to relieve and
alleviate these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve dangerous
conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or
otherwise easements and temporary construction easements in real property for the construction
of sewers and related appurtenances in the project known as Providence Sanitary Relief (SKME-
640) (11700) as hereinafter set forth, said easements and temporary easements being more
particularly described below:
Parcel #14
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT being part of Lot 10 of
Spring Addition To Old Orchard as recorded in Plat Book 8, Page 60 of the St. Louis County,
Missouri Recorder’s Office and being more particularly described as follows:
COMMENCING at the southeastern corner of said Lot 10, said southeastern corner also being
on the northern right-of-way line of Providence (40.00 foot wide) Avenue; THENCE North 82
degrees 40 minutes 23 seconds West along the said northern right-of-way line a distance of 45.90
feet to the POINT OF BEGINNING; THENCE North 82 degrees 40 minutes 23 seconds West
along said northern right-of-way line a distance of 14.22 feet to a point; THENCE North 06
degrees 17 minutes 36 seconds East along the eastern right-of-way line of Robinson (30.00 foot
wide) Avenue as vacated by Ordinance # 8175 a distance of 90.70 feet to a point; THENCE
South 83 degrees 42 minutes 24 seconds East a distance of 14.96 feet to a point; THENCE South
06 degrees 39 minutes 06 seconds West a distance of 31.06 feet to a point; THENCE North 83
degrees 36 minutes 11 seconds West a distance of 1.01 feet to a point; THENCE South 06
degrees 23 minutes 20 seconds West a distance of 21.01 feet to a point; THENCE South 49
degrees 37 minutes 02 seconds West a distance of 2.74 feet to a point; THENCE South 06
degrees 43 minutes 07 seconds West a distance of 32.71 feet to a point; THENCE South 63
degrees 13 minutes 16 seconds West a distance of 0.12 feet to a point; THENCE South 27
degrees 07 minutes 15 seconds East a distance of 4.92 feet to the POINT OF BEGINNING.
The TEMPORARY CONSTRUCTION EASEMENT will become null and void upon
completion of above described construction.
Parcel #22
A 10.00 FOOT WIDE EASEMENT across Lot 26 in Block 1 of Joy Place as recorded in Plat
Book 1, Page 197 of the St. Louis County Recorder’s Office and being more particularly
described as follows:
COMMENCING at the southwestern corner of said Lot 26, said southwestern corner also being
on the northern right-of-way line of Sunnyside (50.00 foot wide) Avenue; THENCE North 07
degrees 31 minutes 53 seconds East along the common line between said Lot 26 and Lot 25 of
said Joy Place a distance of 129.90 feet to the POINT OF BEGINNING of the center line of
herein described 10.00 FOOT WIDE EASEMENT; THENCE South 72 degrees 08 minutes 17
seconds East along said centerline a distance of 70.78 feet to the POINT OF TERMINATION,
said POINT OF TEMINATION also being South 07 degrees 31 minutes 53 seconds West along
the western right-of-way line of Summit (50.00 foot wide) Avenue a distance of 62.79 feet from
the northeastern corner of said Lot 26.
Also a 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT #1 and a
VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT #2 for use during the
construction of any sewer in the above described sewer easement, said TEMPORARY
CONSTRUCTION EASEMENTS being more particularly described as follows:
A 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT #1 lying adjacent to the
southern line of herein described 10.00 FOOT WIDE EASEMENT, bounded on the west by the
said western line of said Lot 26 and bounded on the east by the said western right-of-way line of
Summit (50.00 foot wide) Avenue.
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT #2 COMMENCING at
the said southwestern corner of Lot 26; THENCE North 07 degrees 31 minutes 53 seconds East
along said common line between Lot 26 and Lot 25 of said Joy Place a distance of 134.99 feet to
the POINT OF BEGINNING of herein described VARIABLE WIDTH TEMPORARY
CONSTRUCTION EASEMENT #2; THENCE North 07 degrees 31 minutes 53 seconds East
along said common line between Lot 26 and Lot 25 of said Joy Place a distance of 14.32 feet to a
point; THENCE South 81 degrees 39 minutes 46 seconds East a distance of 35.72 feet to a point;
THENCE South 72 degrees 08 minutes 17 seconds East a distance of 34.47 feet to a point;
THENCE South 07 degrees 31 minutes 53 seconds West along said western right-of-way line of
Summit (50.00 foot wide) Avenue a distance of 20.33 feet to a point; THENCE North 72 degrees
08 minutes 17 seconds West along the northern line of herein described 10.00 FOOT WIDE
EASEMENT a distance of 70.78 feet to the POINT OF BEGINNING.
The two (2) TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon
completion of the above described construction.

A 10.00 FOOT WIDE EASEMENT across Lot 25 in Block 1 of Joy Place as recorded in Plat
Book 1, Page 197 of the St. Louis County Recorder’s Office and being more particularly
described as follows:
COMMENCING at the southwestern corner of said Lot 25, said southwestern corner also being
on the northern right-of-way line of Sunnyside (50.00 foot) Avenue; THENCE North 07 degrees
31 minutes 53 seconds East along the common line between said Lot 25 and Lot 24 of said Joy
Place a distance of 139.02 feet to the POINT OF BEGINNING of the center line of herein
described 10.00 FOOT WIDE EASEMENT; THENCE South 72 degrees 08 minutes 17 seconds
East along said centerline a distance of 50.82 feet to the POINT OF TERMINATION, said
POINT OF TEMINATION also being South 07 degrees 31 minutes 53 seconds West along the
common line between said Lot 25 and Lot 26 of said Joy Place a distance of 50.10 feet from the
northeastern corner of said Lot 25.
Also a 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT #1 and a
VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT #2 for use during the
construction of any sewer in the above described sewer easement, said TEMPORARY
CONSTRUCTION EASEMENTS being more particularly described as follows:
A 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT #1 lying adjacent to the
northern line of herein described 10.00 FOOT WIDE EASEMENT, bounded on the west by the
said western line of said Lot 25 and bounded on the east by the said eastern line of said Lot 25.
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT #2, COMMENCING
at the said southwestern corner of Lot 25; THENCE North 07 degrees 31 minutes 53 seconds
East along the said common line between Lot 25 and Lot 24 a distance of 113.61 feet to the
POINT OF BEGINNING of herein described VARIABLE WIDTH TEMPORARY
CONSTRUCTION EASEMENT #2; THENCE North 07 degrees 31 minutes 53 seconds East
along said common line a distance of 20.33 feet to a point; THENCE South 72 degrees 08
minutes 17 seconds East along the southern line of herein described 10.00 FOOT WIDE
EASEMENT a distance of 50.82 feet to a point; THENCE South 07 degrees 31 minutes 53
seconds West along the said common line between Lot 25 and Lot 26 of said Joy Place a
distance of 1.12 feet to a point; THENCE North 84 degrees 17 minutes 47 seconds West a
distance of 18.28 feet to a point; THENCE South 05 degrees 42 minutes 13 seconds West a
distance of 15.39 feet to a point; THENCE North 72 degrees 08 minutes 17 seconds West a
distance of 32.76 feet to the POINT OF BEGINNING.
The two (2) TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon
completion of the above described construction.

A 10.00 FOOT WIDE EASEMENT across Lot 24 in Block 1 of Joy Place as recorded in Plat
Book 1, Page 197 of the St. Louis County Recorder’s Office and being more particularly
described as follows:
COMMENCING at the southwestern corner of said Lot 24, said southwestern corner also being
on the northern right-of-way line of Sunnyside (50.00 foot) Avenue; THENCE North 07 degrees
31 minutes 53 seconds East along the common line between said Lot 24 and Lot 23 of said Joy
Place a distance of 147.73 feet to the POINT OF BEGINNING of the center line of herein
described 10.00 FOOT WIDE EASEMENT; THENCE South 85 degrees 12 minutes 59 seconds
East along said centerline a distance of 1.77 feet to a point; THENCE South 72 degrees 08
minutes 17 seconds East along said centerline a distance of 49.03 feet to the POINT OF
TERMINATION, said POINT OF TEMINATION also being South 07 degrees 31 minutes 53
seconds West along the common line between said Lot 24 and Lot 25 of said Joy Place a
distance of 40.98 feet from the northeastern corner of said Lot 24.
Also two (2) 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENTS for use
during the construction of any sewer in the above described sewer easement, said 20.00 FOOT
WIDE TEMPORARY CONSTRUCTION EASEMENTS being more particularly described as
follows:
A 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT #1 lying adjacent to the
southern line of herein described 10.00 FOOT WIDE EASEMENT, bounded on the west by the
said western line of said Lot 24 and bounded on the east by the said eastern line of said Lot 24.
A 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT #1 lying adjacent to the
northern lines of herein described 10.00 FOOT WIDE EASEMENT, bounded on the west by the
said western line of said Lot 24 and bounded on the east by the said eastern line of said Lot 24.
The 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENTS will become null and
void upon completion of the above described construction.
Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is
hereby authorized to enter into contracts to acquire by purchase to the extent possible or to
continue with the condemnation process by preparing and/or filing all necessary court pleadings
and documents to institute and prosecute legal actions in condemnation to acquire all easements
for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan
St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private
property rights as hereinabove set out.
The foregoing Ordinance was adopted on March 12, 2015.
