AN ORDINANCE, declaring the necessity for the acquisition of real property,
easements and temporary easements within The Metropolitan St. Louis Sewer District for the
purpose of construction of sewers and related appurtenances in the project known as Deer Creek
Sanitary Tunnel (Clayton Rd to RDP) (11731) in the Cities of Brentwood, Clayton, Richmond
Heights, Maplewood, Shrewsbury, and Webster Groves, Missouri to serve the needs of residents
of the area, and authorizing staff to proceed with further condemnation efforts related to the
project, including but not limited to the purchase and/or the filing of all necessary court
pleadings or documents to commence and prosecute formal legal proceedings for the acquisition
of said real property, easements and temporary construction easements.
WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area
of the County of St. Louis within the Deer Creek Watershed wherein live and work numerous
people; and
WHEREAS, sewage gathered from such area will have no adequate means of
disposition, and will constitute a menace to public health and welfare of the general public and
the residents of The Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer
District to protect the public health and welfare by construction, reconstruction, maintenance or
repair of sewers and related appurtenances on, over and across said area in order to relieve and
alleviate these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve dangerous
conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or
otherwise real property, easements and temporary construction easements for the construction of
sewers and related appurtenances in the project known as Deer Creek Sanitary Tunnel (Clayton
Rd to RDP) (11731) as hereinafter set forth, said real property, easements and temporary
easements being more particularly described below:
Parcel #03
A 50.00 FOOT DIAMETER CYLINDRICAL SUBTERRANEAN EASEMENT through a tract
of land conveyed to Laclede Gas Company by Deed Book 292, Page 425 of the St. Louis County
Recorder’s Office and being more particularly described as follows and the following elevations
are based on North American Vertical Datum of 1988 (NAVD 1988):
COMMENCING at the intersection of the eastern right-of-way line of Shrewsbury Avenue
(varied width) and the common line between said Laclede Gas Company tract and a tract of land
conveyed to Miran Investment Company by Deed Book 6832, Page 1965 of the St. Louis County
Recorder’s Office; THENCE along said common line North 82 degrees 42 minutes 28 seconds
East a distance of 120.01 feet to the POINT OF BEGINNING of herein described center line of a
50.00 FOOT DIAMETER CYLINDRICAL SUBTERRANEAN EASEMENT, said POINT OF
BEGINNING having an elevation of 315.54 feet (NAVD 1988); THENCE along said centerline
North 43 degrees 26 minutes 17 seconds West a distance of 1030.04 feet to the POINT OF
TERMINATION of herein described center line of a 50.00 FOOT DIAMETER CYLINDRICAL
SUBTERRANEAN EASEMENT, said POINT OF TERMINATION having an elevation of
313.48 feet (NAVD 1988) and also being on the common line between said Laclede Gas
Company tract and Burlington Northern Santa Fe Railroad right-of-way (100 feet wide) and
lying North 65 degrees 08 minutes 32 seconds East a distance of 1093.15 feet from the
intersection of said common line with said eastern right-of-way line of Shrewsbury Avenue
(varied width).

A 50.00 FOOT DIAMETER CYLINDRICAL SUBTERRANEAN EASEMENT through a tract
of land being all of Reserve “A” of Greenwood, a subdivision recorded in Plat Book 3, Page 18
and 19 of the St. Louis County Recorder’s Office and being more particularly described as
follows and the following elevations are based on North American Vertical Datum of 1988
(NAVD 1988):
COMMENCING at the intersection of the eastern right-of-way line of Shrewsbury Avenue
(varied width) and the southern line of said Reserve “A”; THENCE along said southern line
South 82 degrees 42 minutes 28 seconds East a distance of 120.01 feet to the POINT OF
BEGINNING of herein described center line of a 50.00 FOOT DIAMETER CYLINDRICAL
SUBTERRANEAN EASEMENT, said POINT OF BEGINNING having an elevation of 315.54
feet (NAVD 1988); THENCE along said centerline North 43 degrees 26 minutes 17 seconds
West a distance of 203.13 feet to the POINT OF TERMINATION of herein described center line
of a 50.00 FOOT DIAMETER CYLINDRICAL SUBTERRANEAN EASEMENT, said POINT
OF TERMINATION having an elevation of 315.95 feet (NAVD 1988) and also being on the
western line of said Reserve “A”.

BEGINNING at the intersection of the eastern line of property described in deed to 4150 Carr
Lane Avenue, LLC recorded in Book 20647, Page 1413 in St. Louis County Records Office with
the northern right-of-way line of Interstate 44, from which a rebar (Pitzman SLS10D) lies North
41 degrees 57 minutes 15 seconds East a distance of 0.53 feet; Thence along the eastern line of
said 4150 Carr Lane Avenue, LLC tract and property described in deed to Carr Lane
Manufacturing Co. recorded in Book 7747, Page 1433 in St. Louis County Records Office, North
24 degrees 42 minutes 45 seconds West a distance of 370.00 feet to a rebar (EDSI); Thence
along the eastern line of said Carr Lane Manufacturing Co tract, North 27 degrees 24 minutes 58
seconds East a distance of 172.87 feet to a point on the southern right-of-way line of Burlington
Northern Santa Fe Railroad (100 feet wide) from which a rebar (Pitzman SLS10D) lies North 46
degrees 35 minutes 28 seconds East, a distance of 0.05 feet; Thence along said southern right-of-
way line, North 65 degrees 08 minutes 32 seconds East a distance of 620.19 feet to a point from
which a rebar (Pitzman SLS10D) lies North 45 degrees 18 minutes 04 seconds West, a distance
of 0.48 feet; Thence leaving said southern right-of-way line, South 24 degrees 51 minutes 28
seconds East a distance of 106.80 feet to a point on the northwestern right-of-way line of

Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is
hereby authorized to enter into contracts to acquire by purchase to the extent possible or to
continue with the condemnation process by preparing and/or filing all necessary court pleadings
and documents to institute and prosecute legal actions in condemnation to acquire all real
property and easements for the above-referenced project, pursuant to the provisions of the
Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for
the appropriation of private property rights as hereinabove set out.
