HomeMy Public PortalAbout14320 City of St. Louis Flood Protection Certification (12726)ORDINANCE NO. 14320 AN ORDINANCE, appropriating Two Hundred Twenty Thousand Dollars ($220,000.00) from the Operations, Maintenance and Construction Improvement Fund of Stormwater Operations Maintenance to be used for cost sharing and financial assistance for flood protection certification in City of St. Louis Flood Protection Certification (12726) in the City of St. Louis, Missouri; and authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into an Intergovernmental Agreement under Contract No. 20392 with the City of St. Louis, Missouri for the aforementioned cost sharing and financial assistance for flood protection certification. WHEREAS, the Charter of The Metropolitan St. Louis Sewer District empowers the District to contract with municipalities, districts, other public agencies, individuals, or private corporations, or any of them whether within or without the District, for the construction, use, or maintenance of common or joint sewers, drains, outlets, or disposal plants, or for the performance of any service required by the District; and WHEREAS, MSD Resolution No. 117 adopted March 18, 1957 and MSD Resolution No. 230 adopted February 12, 1959 memorialized MSD’s commitment to cooperate with the City of St. Louis to achieve adequate flood protection through the Mississippi River Flood Protection Project; and WHEREAS, MSD Ordinance No. 219 adopted August 11, 1958 authorized an assurance of local cooperation on the part of MSD in the Mississippi River Flood Protection project authorized by Act of Congress on August 9, 1955; and WHEREAS, this Intergovernmental Agreement allows the District the ability to provide cost sharing and financial assistance to the City of St. Louis, Missouri for the Flood Protection Certification Project as part of the Mississippi River Flood Protection project authorized by Congress in 1955; and WHEREAS, the Director of Finance has certified that there is an unencumbered balance in the above named fund sufficient to pay the obligation authorized herein. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The sum of Two Hundred Twenty Thousand Dollars ($220,000.00) is hereby appropriated from the Operations, Maintenance and Construction Improvement Fund of Stormwater Operations Maintenance to be used for cost sharing and financial assistance for flood protection certification in City of St. Louis Flood Protection Certification (12726) in the City of St. Louis, Missouri. Section Two. The Executive Director and Secretary-Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter into an Intergovernmental Agreement under Contract No. 20392 with the City of St. Louis, Missouri for cost sharing and financial assistance for flood protection certification. Section Three. The Intergovernmental Agreement authorized in Section Two of this ordinance shall be comprised of such terms and conditions as are approved by the Office of General Counsel of the District. Section Four. This ordinance, being an appropriation ordinance, shall take effect immediately upon its enactment. The foregoing ordinance was adopted on January 14, 2016.
