RESOLUTION AUTHORIZING THE BOROUGH OF CARTE RET
TO AUTHORIZING A COOPERATIVE PRICING AGREEMENT
WITH FOVEONICS IMAGING TECHNOLOGIES
WHEREAS, N.J.S.A. 40A:11-11(5) authorizes contracting units to establish a
Cooperative Pricing System and to enter into Cooperative Pricing Agreements for its
administration; and
WHEREAS, the Educational Services Commission of New Jersey, hereinafter referred
to as the "Lead Agency " has offered voluntary participation in a Cooperative Pricing
System for the purchase of goods and services;
WHEREAS, on December 29, 2022 the governing body of the Borough of Carteret,
County of Middlesex, State of New Jersey duly considered participation in a Cooperative
Pricing System for the provision and performance of goods and services;
BE IT FURTHER RESOLVED, that the governing body of Borough of Carteret,
County of Middlesex pursuant to N.J.A.C. 5:30-5.5(b), the certification of available
funds, shall either certify the full maximum amount of $35,000 against the budget at the
time the contract is awarded, or no contract amount shalt be chargeable or certified rmtil
such time as the goods or services are ordered or otherwise called for prior to placing the
order, and a certification of availability of funds is made by the Chief Finance Officer;
and
BE IT FURTHER RESOLVED, that ilne duration of the contracts between the Borough
of Carteret and the Foveonics Imaging Technologies, Inc., 99 Grayrock Rd. Suite 103
Clinton, NJ 08809 Co -Op will be one year or until the project is complete
This resolution shall take effect immediately upon passage.
