HomeMy Public PortalAbout14355 St. Louis Bike ParkORDINANCE NO. 14355 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer to enter into a lease with St. Louis Bike Park, Inc., for it to continue to operate the property located at Union & Hoffmeister Roads, in St. Louis County, Missouri as a recreational bike park. WHEREAS, The Metropolitan St. Louis Sewer District owns the real property at Union & Hoffmeister Roads, in St. Louis County, Missouri, and WHEREAS, The Metropolitan St. Louis Sewer District is not using the property and has no current plans to use the land, and WHEREAS, the property was previously leased to Gateway Trailnet, Inc. for its use as a recreational bike park, and WHEREAS, St. Louis Bike Park is a successor to Gateway Trailnet Inc. and is “stepping into the shoes” of Gateway Trailnet Inc. to continue to use the property as a recreational bike park, and WHEREAS, pursuant to Ordinance No. 11173, adopted February 20, 2002 the MSD Board of Trustees determined that it was in the public’s interest to lease said property to Gateway Trailnet, Inc. and the public interest was best served by suspending the provisions of Resolution 1960, adopted December 12, 1990 in order to affect said lease. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby lease to St. Louis Bike Park the property at Union & Hoffmeister Roads in St. Louis County, Missouri for it to continue to operate the property as a recreational bike park as part of Grant’s Trail. Section Two. The lease term shall commence on May 1, 2016 and shall expire on April 30, 2017 with five (5) one-year options to renew the lease upon the same terms and conditions. Section Three. The Executive Director and Secretary-Treasurer are hereby authorized to execute on behalf of the District a Lease Agreement giving effect to Sections One and Two hereof, and embodying such other general terms and conditions as are approved by the office of the General Counsel of the District. This foregoing ordinance was adopted on April 14, 2016.
