AN ORDINANCE, appropriating Five Hundred Ninety-Five Thousand Dollars
($595,000.00) from the Operation, Maintenance, Construction, and Improvement Fund of
Coldwater Creek and Eight Hundred Seventy-Five Thousand Dollars ($875,000.00) from the
Sanitary Replacement Fund to be used for private I/I removal and storm sewer construction in
Upper Coldwater Section D I/I Reduction Part 2 (11681) in the Cities of Edmundson, Berkeley,
St. Ann, and Maryland Heights, and Unincorporated St. Louis County, Missouri; and authorizing
the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer
District to enter into Contract No. 20473 with Fred M. Luth & Sons, Inc. for the aforesaid private
I/I removal and storm sewer construction.
WHEREAS, the bid for said private I/I removal and storm sewer construction is
One Million Three Hundred Twenty-Three Thousand Seven Hundred Twenty-Eight Dollars
($1,323,728.00) and the allowance for construction change orders and other project expenses is
One Hundred Forty-Six Thousand Two Hundred Seventy-Two Dollars ($146,272.00); and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Five Hundred Ninety-Five Thousand Dollars
($595,000.00) is hereby appropriated from the Operation, Maintenance, Construction, and
Improvement Fund of Coldwater Creek and the sum of Eight Hundred Seventy-Five Thousand
Dollars ($875,000.00) is hereby appropriated from the Sanitary Replacement Fund for private I/I
removal and storm sewer construction in Upper Coldwater Section D I/I Reduction Part 2
(11681) in the Cities of Edmundson, Berkeley, St. Ann, and Maryland Heights, and
Unincorporated St. Louis County, Missouri.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into Contract
No. 20473 with Fred M. Luth & Sons, Inc., as the lowest responsible bidder for private I/I
removal and storm sewer construction in Upper Coldwater Section D I/I Reduction Part 2
(11681) in the Cities of Edmundson, Berkeley, St. Ann, and Maryland Heights, and
Unincorporated St. Louis County, Missouri, pursuant to bids received on the 20th day of
September 2016.
Section Three. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing ordinance was adopted on November 10, 2016.
