AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer
on behalf of The Metropolitan St. Louis Sewer District (“MSD”) to enter into Intergovernmental
Agreements with five (5) Levee Districts (Earth City, Howard Bend, Chesterfield-Monarch, MO
Bottoms–Bridgeton, and Riverport), whereby MSD and the respective Levee District will agree
on the contracted services to be provided by the Levee District and those services that will be
excluded as specified in the Intergovernmental Agreement.
WHEREAS, the Charter of The Metropolitan St. Louis Sewer District empowers
the District to contract with municipalities, districts, other public agencies, individuals, or private
corporations, or any of them whether within or without the District, for the construction, use, or
maintenance of common or joint sewers, drains, outlets, or disposal plants, or for the
performance of any service required by the District; and for the connection with and use of the
facilities of the District, and
WHEREAS, said Intergovernmental Agreement directs that the Levee District
will provide, within its boundaries, certain services identified as stormwater services. The Levee
District shall not be obligated to provide any additional stormwater services other than as
outlined in the Intergovernmental Agreement,
WHEREAS, MSD will not charge property within the boundaries of the Levee
Districts the current real property tax of $0.10 per $100 of assessed valuation to fund stormwater
operation and maintenance, as such services will be provided by the Levee Districts.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Sescretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into an
Intergovernmental Agreement with the Levee District, whereby the District will contract for
various stormwater services.
Section Two. The Intergovernmental Agreement authorized in Section One of
this ordinance shall be comprised of such terms and conditions as are approved by the General
Counsel of the District.
This foregoing ordinance was adopted on January 12, 2017.
