AN ORDINANCE, declaring the necessity for the acquisition of easements and
temporary easements in certain real property within The Metropolitan St. Louis Sewer District
for the purpose of construction of sewers and related appurtenances in the project known as
Pickwick – Bernadine – Bimini Sanitary Relief Part 2 (11698) in Unincorporated St. Louis
County, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with
further condemnation efforts related to the project, including but not limited to the purchase &/or
the filing of all necessary court pleadings or documents to commence and prosecute formal legal
proceedings for the acquisition of said easements and temporary construction easements.
WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area
of the County of St. Louis within the Gravois Creek Watershed wherein live and work numerous
people; and
WHEREAS, sewage gathered from such area will have no adequate means of
disposition, and will constitute a menace to public health and welfare of the general public and
the residents of The Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer
District to protect the public health and welfare by construction, reconstruction, maintenance or
repair of sewers and related appurtenances on, over and across said area in order to relieve and
alleviate these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve dangerous
conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or
otherwise easements and temporary construction easements in real property for the construction
of sewers and related appurtenances in the project known as Pickwick – Bernadine – Bimini
Sanitary Relief - 11698 as hereinafter set forth, said easements and temporary easements being
more particularly described below:
Parcel #26
A VARIABLE WIDTH EASEMENT across a tract of land being part of Lot 77 of Plat No. 3 of
Waldorf Terrace as recorded in Plat Book 73 Page 50 of the St. Louis County, Missouri
Recorder’s Office, being more particularly described as follows:
COMMENCING at the northeast corner of said Lot 77 said point also being located on the west
line of Archer Park being a subdivision recorded in Book 71, Page 22 of the St. Louis County
Missouri Recorder’s Office; THENCE along the common line of the east line of said Lot 77 and
said west line of Archer Park South 0 degrees 30 minutes 17 seconds West a distance of 2.61 feet
to the POINT OF BEGINNING; Thence continuing along said common line South 0 degrees 30
minutes 17 seconds West a distance of 29.05 feet; Thence South 66 degrees 24 minutes 17
seconds West a distance of 102.90 feet; thence North 53 degrees 23 minutes 38 seconds East a
distance of 117.79 feet to the POINT OF BEGINNING.
Also, a 15.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT for use during the
construction of any sewer in the above described permanent sewer easement, said temporary
construction easement being more particularly described as follows:
A 15.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT adjacent to the north
line of the above described VARIABLE WIDTH EASEMENT bounded on the northeast by the
common line of said Lot 77 and Lot 78 of Plat No. 2 of Waldorf Terrace and the east line of said
Lot 77 and the said west line of Archer Park, bounded on the south by the above described
VARIABLE WIDTH EASEMENT and a 65’ wide easement recorded in Plat Book 73, Page 50
and bounded on the west by the common line of said Lot 77 and Lot 76 of Plat No. 3 of Waldorf
Terrace.
TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of
the above described sewer construction.
Parcel #28
A 10.00 FOOT WIDE EASEMENT across a tract of land being part of Lot 26 of Archer Park as
recorded in Plat Book 71 Page 22 of the St. Louis County, Missouri Recorder’s Office, being
more particularly described as follows:
COMMENCING at the northeast corner of said Lot 26 said point also being on the south right of
way line of Vargas (50’W) Drive; THENCE along a common line being the east line of said Lot
26 and the west line of Lot 27 of said Archer Park South 0 degrees 30 minutes 17 Seconds West
a distance of 179.67 feet to the POINT OF BEGINNING being the centerline of a 10.00 foot
wide easement; Thence along the centerline of said 10.00 foot easement South 70 degrees 48
minutes 00 seconds West a distance of 63.73 feet to the POINT OF TERMINATION on the
common line of said Lot 26 and Lot 25 of said Archer Park
Also one (1) 15.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT for use
during the construction of any sewer in the above described permanent sewer easement, said
temporary construction easement being more particularly described as follows:
A 15.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT lying adjacent to the
northern line of the above described 10.00 FOOT WIDE EASEMENT bounded on the east by
the said common line of Lot 26 and 27 and bounded on the west by the said common line of Lot
26 and 25.
Also one (1) 14.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT for use
during the construction of any sewer in the above described permanent sewer easement, said
temporary construction easement being more particularly described as follows:
A 14.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT lying adjacent to the
southern line of the 10.00 FOOT WIDE EASEMENT bounded on the east by the said common
line of Lot 26 and 27 and bounded on the west by the said common line of Lot 26 and 25.
The above described TEMPORARY CONSTRUCTION Easements will become null and void
upon completion of the above described sewer construction.
Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is
hereby authorized to enter into contracts to acquire by purchase to the extent possible or to
continue with the condemnation process by preparing and/or filing all necessary court pleadings
and documents to institute and prosecute legal actions in condemnation to acquire all easements
for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan
St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private
propert y rights as hereinabove set out.
The foregoing ordinance was adopted on March 16, 2017.
