AN ORDINANCE, appropriating Three Hundred Fifty Thousand Dollars
($350,000.00) from the Wastewater Emergency Fund to be used for emergency excavation and
repair services in Emergency Repair #057 (Lemay Ferry 4532) (12877) in Unincorporated St.
Louis County, Missouri; and authorizing the Executive Director and Secretary-Treasurer on
behalf of The Metropolitan St. Louis Sewer District to enter into an emergency construction
contract under Contract No. 20645 with J.H. Berra Construction Co., Inc. for the aforesaid
emergency excavation and repair services.
WHEREAS, the District staff declared this project an emergency on February 27,
2017; and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Three Hundred Fifty Thousand Dollars ($350,000.00) is
hereby appropriated from the Wastewater Emergency Fund to be used for emergency excavation
and repair services in Emergency Repair #057 (Lemay Ferry 4532) (12877) in Unincorporated
St. Louis County, Missouri.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into an emergency
construction contract under Contract No. 20645 with J.H. Berra Construction Co., Inc. for the
aforesaid emergency excavation and repair services, and shall be comprised of such other terms
and conditions as are approved by the Office of the General Counsel of the District.
Section Three. This ordinance being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing ordinance was adopted on March 16, 2017.
