AN ORDINANCE, appropriating Three Million Dollars ($3,000,000.00) from the
Sanitary Replacement Fund to be used for property acquisition, demolition, and related activities
of real property for construction of a sanitary tunnel and associated structures in RDP Tributaries
(Deer Creek) CSO Tunnel (12441) in various municipalities and Unincorporated St. Louis
County, Missouri; and authorizing the Executive Director and Secretary-Treasurer on behalf of
The Metropolitan St. Louis Sewer District to acquire property and enter into lease agreements
without additional Board action.
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Three Million Dollars ($3,000,000.00) is hereby
appropriated from the Sanitary Replacement Fund for property acquisition, demolition, and
related activities of real property for construction of a sanitary tunnel and associated structures in
RDP Tributaries (Deer Creek) CSO Tunnel (12441) in various municipalities and
Unincorporated St. Louis County, Missouri.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to acquire property and enter
into lease agreements without additional Board action for property acquisition, demolition, and
related activities of real property for construction of a sanitary tunnel and associated structures in
RDP Tributaries (Deer Creek) CSO Tunnel (12441) in various municipalities and
Unincorporated St. Louis County, Missouri, and shall be comprised of such other terms and
conditions as are approved by the Office of the General Counsel of the District.
Section Three. Upon the execution and delivery to the District of a General
Warranty Deed in proper form conveying title to all real property acquired to The Metropolitan
St. Louis Sewer District, the Executive Director and Secretary-Treasurer are hereby authorized to
pay to the respective grantors such amount as approved for said real property.
Section Four. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing ordinance was adopted on July 13, 2017.
