HomeMy Public PortalAbout14692 Gravois Trunk Sanitary Storage Facility (Pardee Ln & Pardee Rd) (12569)ORDINANCE NO. 14692 AN ORDINANCE, declaring the necessity for the acquisition of real property within The Metropolitan St. Louis Sewer District for the purpose of purchasing property due to inadequate storm and sanitary sewers for the project known as Gravois Trunk Sanitary Storage Facility (Pardee Ln and Pardee Rd) (12569) in the City of Crestwood, Missouri to serve the needs of residents of the area, and authorizing the acquisition of said real property by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area in the County of St. Louis within the Gravois Creek Watershed wherein numerous people live and work; and WHEREAS, storm water and sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain real property for the construction of sewers and related appurtenances in the project known as Gravois Trunk Sanitary Storage Facility (Pardee Ln and Pardee Rd) (12569) as hereinafter set forth, said real property being more particularly described below: Gravois Trunk Sanitary Storage Facility (Pardee Ln and Pardee Rd) M.S.D. Project No. 12569 Parcel No. 6 Tract of land being part of Lot 1 of the Subdivision in Partition of the Kennedy Estate in U.S. Survey 9, Township 44 North, Range 6 East, according to the plat accompanying Commissioner's Report in said Partition, a copy of which report and plat is recorded in Deed Book 109, Page 361 of the St. Louis County Records, and being more particularly described as follows: BEGINNING at the intersection of the Easterly line of lot 1A of the Boundary Adjustment Plat No.2, EFS Development Company & City of Crestwood, according to the plat thereof recorded in Plat Book 352, Page 841 of the St. Louis County Records and the Southwest line of Pardee Lane, 40 feet wide, conveyed to St. Louis County for public road by deed recorded in Deed Book 1564, Page 397 of the St. Louis County Records; Thence along said Southwest line South 49 degrees 22 minutes 20 seconds East 219.37 feet to a line 100 feet Northwest from and parallel with the Northwest line of property conveyed to Herman G. Vonder Bruegge and wife by deed recorded in Deed Book 2418, Page 388; Thence along said line South 37 degrees 51 minutes 40 seconds West 339.29 feet to a point in the Eastern line of said lot 1A; Thence along said Eastern line the following courses and distances: North 16 degrees 21 minutes 14 seconds East 12.99 feet; Thence North 10 degrees 43 minutes 14 seconds East 198.50 feet; Thence North 6 degrees 29 minutes 46 seconds West 177.05 feet; Thence North 37 degrees 50 minutes 15 seconds East 34.56 feet to the point of beginning and containing 0.808 acres. Section Two. Counsel for The Metropolitan St. Louis Sewer District is hereby authorized to enter into contracts to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing ordinance was adopted on July 13, 2017.
