AN ORDINANCE, repealing the legal descriptions for Parcels 57, 60, 61 and 62
as described in Ordinance No. 14634, adopted April 13, 2017, and replacing them with the legal
descriptions for Parcels 57, 60, 61 and 62 as described herein, and authorizing staff to now
proceed with condemnation efforts on the easements and temporary easements on Parcels 57, 60,
61 and 62 as described herein.
WHEREAS, Ordinance No. 14634, adopted April 13, 2017, authorized staff to
proceed with further condemnation efforts related to the project know as DC-02 & DC-03
Sanitary Relief (Brentwood Blvd to Conway Rd) Phase II (12471), including but not limited to
the purchase and/or the filing of all necessary court pleadings or documents to commence and
prosecute formal legal proceedings for the acquisition of said real property, easements and
temporary construction easements; and;
WHEREAS, Ordinance No. 14634, adopted April 13, 2017, contained the legal
descriptions for the easements and temporary easements therein described as Parcels 57, 60, 61
and 62; and;
WHEREAS, the project plans have changed such that the legal descriptions for
the easements and temporary easements on Parcels 57, 60, 61 and 62 have been revised; and;
WHEREAS, it is necessary that the Board repeal the portion and only the portion
of Ordinance No. 14634, adopted April 13, 2017, that set forth the legal descriptions for the
easements and temporary easements on Parcels 57, 60, 61 and 62, and authorize staff to now
proceed with condemnation efforts on the easements and temporary easements on Parcels 57, 60,
61 and 62 as described herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The legal descriptions for Parcels 57, 60, 61 and 62 as described in
Ordinance No. 14634, adopted April 13, 2017, are hereby repealed.
Section Two. The legal descriptions for Parcels 57, 60, 61 and 62 are hereby
replaced with the descriptions herein:
Parcel #57
Four (4) EASEMENTS across “Rock Hill Quarries Company Tract No. 1”, a subdivision
recorded in Plat Book 73, Page 15 of the St. Louis County Recorder’s Office, and being in
United States Survey 1930, Township 45 North, Range 6 East, St. Louis County, Missouri and
being more particularly described as follows:
A VARIABLE WIDTH EASEMENT #1, BEGINNING at the intersection of the western line of
Rock Hill Road, 40 feet wide, with the southern line of said Former Missouri Pacific Railroad
Right of Way, 50 feet wide, as shown on said “Rock Hill Quarries Company Tract No. 1”;
THENCE westwardly 60.61 feet along a curve to the left, having a radius of 2,084.80 feet, the
chord of which bears North 61 degrees 52 minutes 20 seconds West, 60.61 feet; THENCE
leaving said southern line South 70 degrees 28 minutes 12 seconds East, 58.08 feet to the
western line of said Rock Hill Road; THENCE along said western line South 08 degrees 00
minutes 22 seconds West, 9.25 feet to the POINT OF BEGINNING.
A 15.00 FOOT WIDE EASEMENT #2, COMMENCING at the point of intersection of the
southern line of the Former Missouri Pacific Railroad Right of Way, 100 feet wide, with the
western line of Lot 8 of the “Charleville Tract”, all as shown on said “Rock Hill Quarries
Company Tract No. 1”; THENCE along the western line of said Lot 8, North 07 degrees 44
minutes 25 seconds East, 7.52 feet to the POINT OF BEGINNING of the center line of the
herein described 15.00 FOOT WIDE EASEMENT #2; THENCE along said center line the
following courses and distances: South 77 degrees 48 minutes 05 seconds East, 95.45 feet; South
79 degrees 35 minutes 00 seconds East, 400.00 feet and South 70 degrees 28 minutes 12 seconds
East, 217.60 feet to the POINT OF TERMINATION of the herein described 15.00 wide

The above five (5) TEMPORARY CONSTRUCTION EASEMENTS will become null and void
upon the completion of the above described construction.

A 15.00 FOOT WIDE EASEMENT across Lot 12 East of the “Boundary Adjustment Plat of the
Resubdivision of Lot 12 of Overbrook Estates” a subdivision recorded in Plat Book 212, Page 28
of the St. Louis County Recorder’s Office and being more particularly described as follows:
BEGINNING at a point in the eastern line of said Lot 12 East, said point being distant South 07
degrees 51 minutes 54 seconds West, 132.64 feet from the northeastern corner of said Lot 12
East said point being also on the western line of “Rock Hill Quarries Company Tract No. 1”, a
subdivision recorded in Plat Book 73, Page 15 of said Recorder’s Office; THENCE North 83
degrees 32 minutes 38 seconds West, 144.37 feet along the center line of said 15.00 FOOT

of the St. Louis County Recorder’s Office and being more particularly described as follows:
BEGINNING at a point in the eastern line of said Lot 12 West, said point being distant South 07
degrees 51 minutes 54 seconds West, 137.06 feet from the northeastern corner of said Lot 12
West; THENCE North 83 degrees 32 minutes 38 seconds West, 215.06 feet along the center line
of said 15.00 FOOT WIDE EASEMENT to the western line of said Lot 12 West and also being
the eastern line of Lot 11 of the “Resubdivision of Lot 11 of Overbrook Estates”, a subdivision
recorded in Plat Book 51, Page 56 of said Recorder’s Office and being the POINT OF
TERMINATION of the herein described 15.00 FOOT WIDE EASEMENT, said POINT OF

The above two (2) TEMPORARY CONSTRUCTION EASEMENTS will become null and void
upon the completion of the above described construction.

A VARIABLE WIDTH EASEMENT across Lot 11 of the “Resubdivision of Lot 11 of
Overbrook Estates”, a subdivision recorded in Plat Book 51, Page 65 of the St. Louis County
Recorder’s Office, and being more particularly described as follows:
BEGINNING at the northwestern corner of said Lot 11; THENCE South 82 degrees 40 minutes
35 seconds East, 45.16 feet along the northern line of said Lot 11 to its northeastern corner;
THENCE South 25 degrees 26 minutes 00 seconds East, 108.71 feet along the northeastern line
of said Lot 11; THENCE leaving the northeastern line of said Lot 11, South 64 degrees 34
minutes 00 seconds West, 74.96 feet; THENCE South 03 degrees 15 minutes 07 seconds West,
155.16 feet; THENCE South 56 degrees 58 minutes 30 seconds East, 335.58 feet to the eastern
line of said Lot 11; THENCE South 07 degrees 51 minutes 54 seconds West, 16.57 feet along
the eastern line of said Lot 11; THENCE leaving the eastern line of said Lot 11, North 56
degrees 58 minutes 30 seconds West, 351.33 feet; THENCE North 03 degrees 15 minutes 07
seconds East, 166.67 feet; THENCE North 82 degrees 08 minutes 35 seconds West, 26.99 feet to
the western line of said Lot 11; THENCE North 07 degrees 51 minutes 25 seconds East, 130.00
feet along the western line of said Lot 11 to the POINT OF BEGINNING, excepting therefrom
those portions covered by the existing easements recorded in Plat Book 27, Page 36.
Also two (2) TEMPORARY CONSTRUCTION EASEMENTS for use during the construction
of any sewer in the above described sewer easement, said TEMPORARY CONSTRUCTION
EASEMENTS being more particularly described as follows:
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT #1 lying adjacent to
the southwestern and southern lines of the herein described VARIABLE WIDTH EASEMENT,
and being more particularly described as follows:
BEGINNING at the intersection of the southern line of the herein described VARIABLE
WIDTH EASEMENT, with the eastern line of said Lot 11; THENCE South 07 degrees 51
minutes 54 seconds West, 38.67 feet along the eastern line of said Lot 11; THENCE leaving the
eastern line of said Lot 11, North 56 degrees 58 minutes 30 seconds West, 395.93 feet to the
western line of said Lot 11; THENCE North 07 degrees 51 minutes 25 seconds East, 185.83 feet
along the western line of said Lot 11 to the southern line of the herein described VARIABLE
WIDTH EASEMENT; THENCE along the southern and southwestern lines of the herein
described VARIABLE WIDTH EASEMENT the following courses and distances: THENCE
South 82 degrees 08 minutes 35 seconds East, 26.99 feet; THENCE South 03 degrees 15 minutes
07 seconds West, 166.67 feet; THENCE South 56 degrees 58 minutes 30 seconds East, 351.33
feet to the POINT OF BEGINNING, excepting therefrom those portions covered by the existing
easement recorded in Plat Book 27, Page 36.
A 35.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT #2 lying northeast, east
and southeast of and adjacent to the northeastern, eastern and southeastern lines of the herein
described VARIABLE WIDTH EASEMENT, bounded on the east by the eastern line of said Lot
11 and bounded on the northeast by the northeastern line of said Lot 11, excepting therefrom
those portions covered by the existing easements recorded in Plat Book 27, Page 36.
The above two (2) TEMPORARY CONSTRUCTION EASEMENTS will become null and void
upon the completion of the above described construction.
Section Three. Staff is hereby authorized to proceed with condemnation efforts
on the easements and temporary easements on Parcels 57, 60, 61 and 62 as described herein.
