AN ORDINANCE, making an appropriation of Fifty Million Dollars
($50,000,000.00) from the Sanitary Replacement Fund to be used for sanitary sewer construction
in Deer Creek Sanitary Tunnel (Clayton Rd to RDP) (11731) in the Cities of Clayton, Richmond
Heights, Brentwood, Maplewood, Webster Groves, and Shrewsbury, Missouri; and authorizing
the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer
District to enter into Contract No. 20437 with SAK Construction, LLC for sanitary sewer
construction.
WHEREAS, the bid for said sanitary sewer construction is One Hundred Forty-
Seven Million Seven Hundred Seventy-Seven Thousand Seven Hundred Seventy-Seven and
77/100 Dollars ($147,777,777.77) and the allowance for construction change orders and other
project expenses is Five Million Two Hundred Twenty-Two Thousand Two Hundred Twenty-
Two and 23/100 Dollars ($5,222,222.23);
WHEREAS, a supplemental appropriation request is planned for Fiscal Years
2019, 2020, and 2021 (FY2019, FY2020, FY2021) for a total appropriation amount of One
Hundred Fifty-Three Million Dollars ($153,000,000.00); and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Fifty Million Dollars ($50,000,000.00) is hereby
appropriated from the Sanitary Replacement Fund for sanitary sewer construction in Deer Creek
Sanitary Tunnel (Clayton Rd to RDP) (11731) in the Cities of Clayton, Richmond Heights,
Brentwood, Maplewood, Webster Groves, and Shrewsbury, Missouri.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into Contract No.
20437 with SAK Construction, LLC as the lowest responsible bidder for sanitary sewer
construction in Deer Creek Sanitary Tunnel (Clayton Rd to RDP) (11731) in the Cities of
Clayton, Richmond Heights, Brentwood, Maplewood, Webster Groves, and Shrewsbury,
Missouri, pursuant to bids received on the 1st day of September, 2016.
Section Three. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing ordinance was adopted on August 10, 2017.
