HomeMy Public PortalAbout14812 Patrina Court Bank Stabilization (11018)ORDINANCE NO. 14812 AN ORDINANCE, declaring the necessity for the acquisition of temporary construction easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of a natural channel stabilization with appurtenances in the project known as Patrina Court Bank Stabilization (11018) in Unincorporated St. Louis County, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said temporary construction easements. WHEREAS, there exists within the District an area of the County of St. Louis within the Gravois Creek Watershed wherein live and work numerous people; WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of the District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise temporary construction easements in real property for the construction of a natural channel stabilization with appurtenances in the project known as Patrina Court Bank Stabilization - 11018 as hereinafter set forth, said temporary construction easements being more particularly described below: Parcel #3 A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT across part of Lot 10 of THOS. J. SAPPINGTON ESTATE SUBDIVISION, in Section 20, Township 44 North, Range 6 East, St. Louis County, Missouri and being more particularly described as follows: COMMENCING at a point in the South line of Littie Road, 40 feet wide, distance South 89 degrees 34 minutes East, 350 feet from the East line of property conveyed to Hans J. Samann by deed recorded in Book 1200 page 253 of the St. Louis County Recorder’s Office, being also the Northeast corner of property conveyed to Zelmer L. Hines and wife by deed recorded December 1, 1944, Daily # 18; THENCE South 89 degrees 20 minutes 42 seconds East along the said South line of Littie Road, said South line of Littie Road also being the north line of a tract of land conveyed to Norman W. Woessner, Trustee by deed recorded in Deed Book 20515, Page 1159 of said St. Louis County Recorder’s Office a distance of 94.99 feet to the POINT OF BEGINNING of herein described VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT; THENCE South 89 degrees 20 minutes 42 seconds East along said South line of Littie Road a distance of 10.00 feet to a point; THENCE South 00 degrees 28 minutes 18 seconds West a distance of 93.30 feet to a point; THENCE South 19 degrees 31 minutes 42 seconds East a distance of 58.51 feet to a point; THENCE South 00 degrees 28 minutes 18 seconds West along the western line of a tract of land conveyed to Robert James Bisso and Brenda Kay Bisso by deed recorded in Deed Book 13923, Page 1283 of said St. Louis County Recorder’s Office, said western line also being the eastern line of said tract of land conveyed to Norman W. Woessner, Trustee a distance of 121.78 feet to the southeastern corner of said tract of land conveyed to Norman W. Woessner, Trustee; THENCE North 89 degrees 20 minutes 42 seconds West along the southern line of said tract of land conveyed to Norman W. Woessner, Trustee said southern line also being the Northern line of PATRINA COURT a subdivision as recorded in Plat Book 103, Page 59 of said St. Louis County Recorder’s Office, a distance of 125.00 feet to the southwestern corner of said tract of land conveyed to Norman W. Woessner, Trustee; THENCE North 00 degrees 28 minutes 18 seconds East along the western line of said tract of land conveyed Norman W. Woessner, Trustee, said western line also being the eastern line of a tract of land conveyed to Frank Rohatsch and Ann Rohatsch, Trustee by deed recorded in Deed Book 20495, Page 100 of said St. Louis County Recorder’s Office, a distance of 25.00 feet to a point; THENCE North 86 degrees 04 minutes 48 seconds East a distance of 115.34 feet to a point; THENCE North 00 degrees 28 minutes 18 seconds East a distance of 85.79 feet to a point; THENCE North 19 degrees 31 minutes 42 seconds West a distance of 58.51 feet to a point; THENCE North 00 degrees 28 minutes 18 seconds East a distance of 95.10 feet to the POINT OF BEGINNING. The VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of the above described construction. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing ordinance was adopted on November 9, 2017.
