AN ORDINANCE, appropriating Five Hundred Sixty Thousand Dollars
($560,000.00) from the Operation, Maintenance, Construction, and Improvement Fund of Sugar
Creek to be used for storm sewer construction in Rosewood Lane & Woodard Dr. Storm Sewer
(10347) in the City of Kirkwood, Missouri; and authorizing the Executive Director and
Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into Contract
No. 21626 with Bates Utility Company, Inc. for the aforesaid storm sewer construction.
WHEREAS, the bid for said storm sewer construction is Four Hundred Ninety-
Five Thousand Eight Hundred Twenty-Five Dollars ($495,825.00) and the allowance for
construction change orders and other project expenses is Sixty-Four Thousand One Hundred
Seventy-Five Dollars ($64,175.00); and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Five Hundred Sixty Thousand Dollars ($560,000.00) is
hereby appropriated from the Operation, Maintenance, Construction, and Improvement Fund of
Sugar Creek for storm sewer construction in Rosewood Lane & Woodard Dr. Storm Sewer
(10347) in the City of Kirkwood, Missouri; said contract being comprised of such terms and
conditions as have been approved by the Office of the General Counsel of the District.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into Contract
No. 21626 with Bates Utility Company, Inc., as the lowest responsible bidder for storm sewer
construction in Rosewood Lane & Woodard Dr. Storm Sewer (10347) in the City of Kirkwood,
Missouri, pursuant to bids received on the 14th day of November, 2017.
Section Three. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing Ordinance was adopted on January 11, 2018.
