AN ORDINANCE, declaring the necessity for the acquisition of easements and
temporary easements in certain real property within The Metropolitan St. Louis Sewer District
for the purpose of construction of sewers and related appurtenances in the project known as
DC-02 & DC-03 Sanitary Relief (Brentwood Blvd to Conway Rd) Phase III and IV (12472) in
the City of Ladue, Missouri to serve the needs of residents of the area, and authorizing staff to
proceed with further condemnation efforts related to the project, including but not limited to the
purchase and/or the filing of all necessary court pleadings or documents to commence and
prosecute formal legal proceedings for the acquisition of said easements and temporary
construction easements.
WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area
of the County of St. Louis within the Deer Creek Watershed wherein live and work numerous
people;
WHEREAS, sewage gathered from such area will have no adequate means of
disposition, and will constitute a menace to public health and welfare of the general public and
the residents of The Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer
District to protect the public health and welfare by construction, reconstruction, maintenance or
repair of sewers and related appurtenances on, over and across said area in order to relieve and
alleviate these conditions.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve dangerous
conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or
otherwise easements and temporary construction easements in real property for the construction
of sewers and related appurtenances in the project known as DC-02 & DC-03 Sanitary Relief
(Brentwood Blvd to Conway Rd) Phase III and IV (12472) as hereinafter set forth, said
easements and temporary easements being more particularly described below:
Parcel #65
Three (3) EASEMENTS, across Lot 10 of the Subdivision of Overbrook Estates, as recorded in
Plat Book 27, Page 36, of the St. Louis County, Missouri Recorders Office and being more
particularly described as follows:
15 FOOT WIDE EASEMENT (#1), COMMENCING at the Northeastern corner of said Lot 10;
THENCE South 07 degrees 51 minutes 25 seconds West, along the Eastern line of said Lot 10, a
distance of 87.50 feet to the POINT OF BEGINNING of the herein described centerline of the
15 FOOT WIDE EASEMENT (#1); THENCE North 82 degrees 12 minutes 05 seconds West, a
distance of 274.99 feet, to the Western line of said Lot 10 and the POINT OF TERMINATION
of the herein described centerline.
The sidelines of said easement to be shortened and lengthened to terminate at the Eastern and
Western line said Lot 10.
15 FOOT WIDE EASEMENT (#2), COMMENCING at the Northeastern corner of said Lot 10;
THENCE South 07 degrees 51 minutes 25 seconds West, along the Eastern line of said Lot 10, a
distance of 40.12 feet to the POINT OF BEGINNING of the herein described centerline of the
15 FOOT WIDE EASEMENT (#2); THENCE North 25 degrees 26 minutes 00 seconds West, a
distance of 47.71 feet, to the Northern line of said Lot 10 and the POINT OF TERMINATION of
the herein described centerline.
The sidelines of said easement to be shortened and lengthened to terminate at the Northern and
Eastern line said Lot 10.
EASEMENT (#3), COMMENCING at the Northwestern corner of said Lot 10; THENCE South
82 degrees 40 minutes 35 seconds East, along the Northern line of said Lot 10, a distance of
88.28 feet to the POINT OF BEGINNING of the herein described EASEMENT (#3); THENCE
continuing, South 82 degrees 40 minutes 35 seconds East, along said Northern line, a distance of
5.92 feet to a point; THENCE South 66 degrees 49 minutes 27 seconds West, a distance of 5.10
feet to a point; THENCE North 23 degrees 10 minutes 33 seconds West, a distance of 3.00 feet
to the Northern line of said Lot 10 and the POINT OF BEGINNING.
Four (4) TEMPORARY CONSTRUCTION EASEMENTS, across Lot 10 of the Subdivision of
Overbrook Estates, as recorded in Plat Book 27, Page 36, of the St. Louis County, Missouri
Recorders Office, said TEMPORARY CONSTRUCTION EASEMENTS are for use during the
construction of any sewer in the above described sewer easements and will become null and void
upon completion of the above described construction, said TEMPORARY CONSTRUCTION
EASEMENTS being more particularly described as follows:
35 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT (#1), bounded by and
adjoining the Southern line of the herein described 15 FOOT WIDE EASEMENT (#1) and being
bounded by the Western and Eastern lines of said Lot 10.
TEMPORARY CONSTRUCTION EASEMENT (#2), COMMENCING at the Northwestern
corner of said Lot 10; THENCE South 07 degrees 51 minutes 25 seconds West, along the
Western line of said Lot 10, a distance of 52.45 feet to the POINT OF BEGINNING of the
herein described TEMPORARY CONSTRUCTION EASEMENT (#2); THENCE South 82
degrees 08 minutes 05 seconds East, a distance of 214.99 feet to a point; THENCE North 07
degrees 51 minutes 21 seconds East, a distance of 28.86 feet to a point; THENCE North 25
degrees 26 minutes 00 seconds West, a distance of 30.47 feet to the Northern line of said Lot 10;

Northern line of said Lot 10, a distance of 65.07 feet to the POINT OF BEGINNING of herein
described TEMPORARY CONSTRUCTION EASEMENT (#4); THENCE continuing South 82

15 FOOT WIDE EASEMENT (#1), COMMENCING at the Northwestern corner of said Lot 7,
THENCE South 06 degrees 42 minutes 25 seconds West, along the Eastern right of way of
Overbrook Drive (50-foot-wide), a distance of 240.84 feet, to the POINT OF BEGINNING of
the herein described centerline of the 15 FOOT WIDE EASEMENT (#1); THENCE South 53
degrees 14 minutes 22 seconds East, along said centerline, a distance of 67.95 feet to “POINT
A”; THENCE South 83 degrees 45 minutes 52 seconds East, a distance of 260.00 feet to a point;
THENCE South 12 degrees 53 minutes 01 seconds East, a distance of 43.20 feet, to the Southern
line of said Lot 7 and the POINT OF TERMINATION of the herein described centerline.
The sidelines of said easement to be shortened or lengthened to terminate at the Western and

The sidelines of said easement to be shortened or lengthened to terminate at the Southern line of

the Overbrook Estates, as recorded in Plat Book 27, Page 36, of the St. Louis County, Missouri
Recorders Office, said TEMPORARY CONSTRUCTION EASEMENTS are for use during the
construction of any sewer in the above described sewer easements and will become null and void
upon completion of the above described construction, said TEMPORARY CONSTRUCTION
EASEMENTS being more particularly described as follows:
TEMPORARY CONSTRUCTION EASEMENT (#1), COMMENCING at the Southwest corner
of said Lot 7, THENCE North 06 degrees 42 minutes 25 seconds East, along the Western line of
said Lot 7 and the Eastern right of way of Overbrook Drive (50-foot-wide), a distance of 77.67
feet, to the POINT OF BEGINNING of the herein described TEMPORARY CONSTRUCTION
EASEMENT (#1); THENCE continuing North 06 degrees 42 minutes 25 seconds East, along
