AN ORDINANCE, authorizing and directing the Executive Director and
Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to lease to Bardho,
LLC, certain real property of the District in the City of St. Louis, Missouri for use as a parking
lot, and to execute a Lease Agreement upon the terms and conditions hereinafter set out.
WHEREAS, the use of said property as herein specified will not interfere with
any District operations.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer on behalf of The
Metropolitan St. Louis Sewer District are hereby authorized and directed to lease to Bardho,
LLC, upon the terms and conditions hereinafter set out, for use as a parking lot, the following
described real property of the District in the City of St. Louis, Missouri, to wit:
A part of Lot 46 of MURDOCH FARM SUBDIVISION and in Block 6266 of the City of
St. Louis, Mo., and described as follows: Beginning in the north line of Chippewa Street
(variable width) at its intersection with the eastern line of the River des Peres Drainage
Works Right-of-Way, 270' wide; thence N 34° 18'20" W along said Drainage Works
eastern right-of-way line, 154.39' to a point herein designated Point "A"; thence
continuing northwardly along said eastern right-of-way line, 17.00' to the northernmost
corner of property conveyed to Charles H. Edelmann and wife by deed recorded in Book
7403, Page 146, City of St. Louis Recorder's office; thence southeastwardly along the
northeastern line of said Edelmann property, 26' + to its intersection with a line extending
eastwardly from said point "A" and perpendicular to said eastern right-of-way line;
thence eastwardly along said last described perpendicular line, 40' + to its intersection
with the southwestern line of Lot 38 according to the subdivision of Block 50 and the
north part of Block 54 of "St. Louis Hills No. 2" as recorded in Surveyors Record Book
10, Page 82, City of St. Louis Recorder's office; thence northwestwardly, 89' + along the
southwestern lines of Lots 38, 37, and 36 of said subdivision as recorded in said
Surveyors Record, to the eastern right-of-way line of the River des Peres Drainage
Works; this point being a distance of 219.39' from the point of beginning; thence N 34°
18' 20" W along said right-of-way line 40.00'; thence S 55° 41' 40" W, 42.50'; thence S
33° 59' 35" E, 250.13' to a point in the north line of easement granted for widening of
said Chippewa Street; thence N 50° 16' 40" E along said easement line 0.63' to an angle
point in said easement line; thence N 67° 51' 55" E along said easement line 44.23' to the
point of beginning.
Section Two. The lease shall be for an original term of two (2) years,
commencing October 1, 2018 and terminating September 30, 2020, at the rental of Thirty Dollars
($30.00) per month, with five (5), one-year options to renew the lease upon the same terms and
conditions.
Section Three. The Executive Director and Secretary-Treasurer on behalf of The
Metropolitan St. Louis Sewer District are hereby authorized and directed to execute a Lease
Agreement giving effect to Sections One and Two of this Ordinance hereof, and embodying such
other terms and conditions as approved by the Office of General Counsel of the District.
Accordingly, this ordinance shall take effect upon its enactment.
The foregoing ordinance has been adopted on September 13, 2018.
