HomeMy Public PortalAbout15061 DC-02 & DC-03 Sanitary Relief (Brentwood Blvd to Conway Rd) Phase III and Phase IV (12472)ORDINANCE NO. 15061 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary construction easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as DC-02 & DC-03 Sanitary Relief (Brentwood Blvd to Conway Rd) Phase III and Phase IV (12472) in the City of Ladue, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase &/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of the County of St. Louis within the Deer Creek Watershed wherein live and work numerous people; and WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as DC-02 & DC-03 Sanitary Relief (Brentwood Blvd to Conway Rd) Phase III and Phase IV (12472) as hereinafter set forth, said easements and TEMPORARY easements being more particularly described below: Parcel #118 Five (5) EASEMENTS, across a tract of land conveyed to the School District of the City of Ladue, as described in Deed Book 2736, Page 349, Deed Book 2744, Page 278, Deed Book 2772, Page 467, Deed Book 6322, Page 1924, Deed Book 6346, Page 2015, Deed Book 6357, Page 1744 and Deed Book 6550, Page 219, of the St. Louis County, Missouri Recorders Office, being more particularly described as follows: 10 FOOT WIDE EASEMENT (#1), COMMENCING at the intersection of the West right of way of Warson Road (70 foot wide) and the North line of a Park, as shown on Briarwood, a subdivision, as recorded in Plat Book 52, Page 25, said North line being 20.00 feet North of and parallel with the North right of way of Springwood Drive (40 foot wide); THENCE North 00 degrees 38 minutes 39 seconds East, along said West right of way, a distance of 178.54 feet to the POINT OF BEGINNING of the herein described centerline of the 10 FOOT WIDE EASEMENT (#1); THENCE North 88 degrees 03 minutes 43 seconds West, a distance of 93.49 feet to “POINT A”; THENCE North 62 degrees 55 minutes 10 seconds West, a distance of 186.77 feet to the POINT OF TERMINATION of the herein described centerline. The sidelines of said easement to be shortened or lengthened to terminate at the West right of way line of said Warson Road (70 foot wide). Also, a 10 FOOT WIDE EASEMENT (being part of 10 FOOT WIDE EASEMENT (#1)), the centerline being more particularly described as follows: BEGINNING at “POINT A” as described in the aforesaid 10 FOOT WIDE EASEMENT (#1); THENCE South 29 degrees 40 minutes 00 seconds West, along said centerline, a distance of 145.57 feet, to the POINT OF TERMINATION of the herein described centerline. 15 FOOT WIDE EASEMENT (#2), COMMENCING at the Southeast corner of Lot 4 of the Denny Tract, a subdivision, as recorded in Plat Book 70, Page 24; THENCE North 89 degrees 22 minutes 54 seconds West, along the South line of said Lot 4, a distance of 1.39 feet, to the West right of way of Warson Road (60 foot wide); THENCE South 00 degrees 38 minutes 39 seconds West, along said West right of way, a distance of 99.54 feet, to the POINT OF BEGINNING of the herein described centerline of the 15 FOOT WIDE EASEMENT (#2); THENCE North 51 degrees 13 minutes 03 seconds West, a distance of 766.20 feet to a point; THENCE North 66 degrees 49 minutes 09 seconds West, a distance of 287.63 feet, to “POINT B”; THENCE continuing North 66 degrees 49 minutes 09 seconds West, a distance of 69.53 feet, to “POINT C”; THENCE continuing North 66 degrees 49 minutes 09 seconds West, a distance of 293.49 feet, to the POINT OF TERMINATION of the herein described centerline. The sidelines of said easement to be shortened or lengthened to terminate at the West right of way of the aforesaid Warson Road (60 foot wide) and the centerline of the Missouri Pacific Railroad Company, Creve Coeur Branch (Abandoned). Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out.
