AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer
on behalf of The Metropolitan St. Louis Sewer District to convey a portion of certain real
property of the District being part of the Oriole-Gilmore Detention Basin Expansion (10723)
located on the Southwest of the intersection of Switzer and Gilmore at the end of Gilmore, in the
City of St. Louis, Missouri for the expansion of the existing sidewalk and to execute and deliver
a General Warranty Deed and such other instruments as may be necessary to effect the
conveyances.
WHEREAS, the City of St. Louis, Missouri requires the portion of said real
property to allow for the constructed cul-de-sac to be within public right of way along with the
sidewalk that is parallel with the cul-de-sac;
WHEREAS, the conveyance of the portion of said real property will not interfere
with the operation of the storage basin, and
WHEREAS, pursuant to Resolution 2016, adopted September 18, 1991, the
District is authorized to make the aforesaid conveyances through negotiation to another public
agency such as the City of St. Louis, Missouri.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to convey a portion of certain
real property of the District being part of the Oriole-Gilmore Detention Basin Expansion to the
City of St. Louis, Missouri for the newly constructed cul-de-sac.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized to on behalf of The Metropolitan St. Louis Sewer District to execute and deliver a
Right of Way Dedication and such other instruments as may be necessary to effect the aforesaid
conveyances to the City of St. Louis, Missouri, said Dedication and instruments to be comprised
of such terms and conditions as are approved by the Office of the General Counsel of the
District.
The foregoing Ordinance was adopted on February 14, 2019.
