AN ORDINANCE, making an appropriation of Thirteen Million Dollars
($13,000,000.00) from the Sanitary Replacement Fund to be used for sanitary sewer construction
in DC-02 & DC-03 Sanitary Relief (Brentwood Blvd to Conway Rd) Phase III and Phase IV
(12472) in the City of Ladue, Missouri; and authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into Contract No.
21786 with J. H. Berra Construction Co., Inc. for sanitary sewer construction.
WHEREAS, the bid for said sanitary sewer construction is Forty-Three Million
Five Hundred Sixty-Eight Thousand Seven Hundred Thirty-Four Dollars ($43,568,734.00) and
the allowance for construction change orders and other project expenses is One Million Nine
Hundred Thirty-One Thousand Two Hundred Sixty-Six Dollars ($1,931,266.00);
WHEREAS, a supplemental appropriation request is planned for Fiscal Year 2021
and Fiscal Year 2022 (FY2021 and FY2022) for a total appropriation amount of Forty-Five
Million Five Hundred Thousand Dollars ($45,500,000.00); and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Thirteen Million Dollars ($13,000,000.00) is hereby
appropriated from the Sanitary Replacement Fund for sanitary sewer construction in DC-02 &
DC-03 Sanitary Relief (Brentwood Blvd to Conway Rd) Phase III and Phase IV (12472) in the
City of Ladue, Missouri; said contract being comprised of such terms and conditions as have
been approved by the Office of the General Counsel of the District.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into Contract No.
21786 with J. H. Berra Construction Co., Inc. as the lowest responsible bidder for sanitary sewer
construction in DC-02 & DC-03 Sanitary Relief (Brentwood Blvd to Conway Rd) Phase III and
Phase IV (12472) in the City of Ladue, Missouri, pursuant to bids received on the 10th day of
May, 2019.
Section Three. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing ordinance was adopted on July 11, 2019.
