HomeMy Public PortalAbout15254 Lindley Drive Sanitary Relief (I-I70 to Ashmont Dr) (UR-07) 12329ORDINANCE NO. 15254 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as Lindley Drive Sanitary Relief (I-170 to Ashmont Dr) (UR-07) (12329) to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of Olivette, County of St. Louis within The University City Branch Watershed wherein live and work numerous people; and WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as Lindley Drive Sanitary Relief (I-170 to Ashmont Dr) (UR-07) (12329) as hereinafter set forth, said easements and temporary easements being more particularly described below: Parcel #2 A VARIABLE WIDTH SEWER EASEMENT across a tract of land being part of the Northwest 1/4 of Section 5 in Township 45 North, Range 6 East and being part of the Southwest 1/2 of the Right-Of-Way of the Chicago, Rock Island and Pacific Railroad, and part of Lot 9 of Stoneleigh Towers, as recorded in Plat Book 24 Page 50 and being part of the same tract as conveyed to Stoneleigh Towers Trustees by Deed Book 977, Page 241 as recorded with the St. Louis County, Missouri Recorder’s Office, and being more particularly described as follows: BEGINNING at the Southerly corner of said Lot 9 also being the Southeasterly corner of Lot 8 as depicted in Stoneleigh Towers as recorded in Plat Book 24 Page 50; THENCE, North 41 degrees 42 minutes 00 seconds East, along the Northwest line of said tract described in Deed Book 977 Page 241, a distance of 35.95 feet; THENCE, leaving said Northwest line North 81 degrees 57 minutes 04 seconds East, a distance of 30.02 feet; THENCE, North 41 degrees 31 minutes 20 seconds East, a distance of 219.56 feet to a point on the Easterly prolongation of the Southern line of Lot 10 of said Stoneleigh Towers; THENCE, South 74 degrees 20 minutes 11 seconds East, a distance 11.11 feet; THENCE, South 41 degrees 31 minutes 20 seconds West, a distance of 257.28 feet; THENCE, North 89 degrees 42 minutes 48 seconds West, a distance of 39.34 feet to the said Southerly corner of Lot 9 being the POINT OF BEGINNING, excepting therefrom the portions covered by the existing easements recorded in Deed Book 7477 Page 135 and Plat Book 24 Page 50 of said Recorder’s Office. Also, two (2) TEMPORARY CONSTRUCTION EASEMENTS for use during the construction of any sewer in the above described VARIABLE WIDTH SEWER EASEMENT, said TEMPORARY CONSTRUCTION EASEMENTS being more particularly described as follows: A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT NO. 1. BEGINNING at the original Northeast corner of said Lot 9; THENCE, South 74 degrees 20 minutes 11 seconds East, a distance of 20.83 feet; THENCE, South 41 degrees 31 minutes 20 seconds West a distance of 219.56 feet; THENCE, South 81 degrees 57 minutes 04 seconds West, a distance of 30.02 feet to a point on the Northwest line of said tract described in Deed Book 977 Page 241; THENCE, North 41 degrees 42 minutes 00 seconds East, a distance of 233.21 feet to the POINT OF BEGINNING, excepting therefrom the portions covered by the existing easement recorded in Plat Bok 24 Page 50 of the said Recorder’s Office. A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT NO. 2. Parcel #3 A VARIABLE WIDTH SEWER EASEMENT across a tract of land being part of Lot 9 of Stoneleigh Towers as recorded in Plat Book 24 Page 50 as recorded with the St. Louis County, Missouri Recorder’s Office, and being more particularly described as follows: BEGINNING at the Southerly corner of said Lot 9 of Stoneleigh Towers as recorded in Plat Book 24 Page 50; THENCE, along the Southwest line of said Lot 9, North 34 degrees 02 minutes 48 seconds West, a distance of 30.84 feet; THENCE leaving said Southwest line, South 89 degrees 42 minutes 48 seconds East, a distance of 39.85 feet to a point on the Northwest line of a tract of land conveyed to Stoneleigh Towers Trustees by Deed Book 977 Page 241 as recorded with said Recorder’s Office; THENCE, along said Northwest line, South 41 degrees 42 minutes 00 seconds West, a distance of 33.95 feet to the POINT OF BEGINNING, excepting therefrom the portions covered by the existing easement recorded in Plat Book 24 Page 50 of said Recorder’s Office.
