AN ORDINANCE, appropriating Two Million Three Hundred Fifty Thousand
Dollars ($2,350,000.00) from the Clean Water Capital Improvement Trust Fund for the
purchase of certain real property and improvements thereon in the City of St. Louis, Missouri,
known and numbered as 140 East Prairie Avenue; and authorizing the Executive Director and
Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to purchase from
the owners thereof the aforementioned real property.
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Two Million Three Hundred Fifty Thousand Dollars
($2,350,000.00) is hereby appropriated from the Clean Water Capital Improvement Trust
Fund for the purchase of certain real property and improvements thereon, in the City of St.
Louis, Missouri, known and numbered as 140 East Prairie Avenue, to be used for the general
purposes of the District, including but not limited to odor control and future expansion of the
Bissell Point Wastewater Treatment Plant.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to purchase from the owners
thereof the following real property and improvements thereon in the City of St. Louis, Missouri,
known and numbered as 140 East Prairie Avenue, and more particularly described as follows:
Beginning at the intersection of the centerline of Stockton Street, vacated by
Ordinance Nos. 45703 and 48309, with the southeast line of East Prairie
Avenue, 60 feet wide; thence southeast along the centerline of vacated
Stockton Street a distance of 277.09 feet to the most northern corner of
property conveyed to Metropolitan St. Louis Sewer District by deed recorded in
Book 589M Page 457 of the City of St. Louis Records; thence southeast along
the northern line of said Metropolitan St. Louis Sewer District property a
distance of 179.60 feet by deed, 179.70 feet by survey to an angle point in
said northern line; thence continuing along said northern line in a southeasterly
direction and along a line parallel to the centerline of vacated Stockton Street a
distance of 50.00 feet to an angle point; thence northeast along a line parallel
to the southeast line of East Prairie Avenue a distance of 18.50 feet to an
angle point; thence southeast along a line parallel to the centerline of vacated
Stockton Street a distance of 50.00 feet to the most eastern corner of said
Metropolitan St. Louis Sewer District property, said corner being also on the
southeast line of Lot 5 in said Block 3328 distant 131.00 feet northeast of the
centerline of said vacated Stockton Street; thence northeast along the southeast
line of said Lot 5 and along it northeastern prolongation a distance of 319.00
feet to a point on the southeast line of Lot 5 in said Block 3327 distant 40.00
feet northeast of the northeast line of vacated Whitman Street; thence southeast
along a line parallel to the centerline of vacated Stockton Street a distance of
28.00 feet; thence northeast along a line parallel to the southeast line of East
Prairie Avenue, a distance of 20.00 feet to a point distant 185.00 feet
southeast of the southeast line of vacated Gano Street as measured along a
line parallel to the centerline of vacated Stockton Street; thence northwest along
a line parallel to the centerline of vacated Stockton Street a distance of 185.00
feet to the southeast line of vacated Gano Street; thence northeast along the
southeast line of vacated Gano Avenue a distance of 160.00 feet to a point
distant 100.00 feet southeast of the southwest line of vacated Powder Street as
measured along the southeast line of vacated Gano Avenue; thence northwest
along a line parallel to the centerline of vacated Stockton Street a distance of
360.00 feet by record, 360.09 feet by survey to a point on the southeast line
of East Prairie Avenue distant 100.00 feet southwest of its intersection with the
southwest line of vacated Powder Street; thence southwest along the southeast
line of East Prairie Avenue a distance of 630.00 feet to the point of beginning.
Section Three. Upon the execution and delivery to them by said owners of a
Warranty Deed in proper form, being free from liens and encumbrances, conveying title to said
land and improvements thereon to The Metropolitan St. Louis Sewer District, the Executive
Director and Secretary-Treasurer are hereby authorized to pay to said owners for said real
property and improvements thereon a total sum not to exceed Two Million Three Hundred
Thousand Dollars ($2,300,000.00).
Section Four. The Executive Director and Secretary-Treasurer are also
authorized to expend not more than Fifty Thousand Dollars ($50,000.00) for costs and
expenses associated with such purchase including, but not limited to taxes, title and closing
fees.
Section Five. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing Ordinance was adopted June 12, 1997.
